Summary
During the political turmoil of 2006–07, a great deal of media and other expert attention has focused on the effects political instability might have on the business community. This chapter is an attempt to provide insights into business perceptions, from a member of Thailand' foreign business community.
It is difficult to generalize because there are a range of experiences. Some businesses have been in Thailand thirty years or more, and seen such instability before, while others have been there for quite a short period of time, and could be fazed by the events. It was some time ago (perhaps twenty years) that I was with some very senior Thai business people, and as we drove past a military establishment, I made some comment about military coups. The response, after the initial deathly silence was: “Mr Robinson, we in Thailand have a coup on the first Tuesday of each month. It starts at 11 a.m. and must be finished by lunchtime.” Such was the frequency of coups at that time, and the lack of gravity with which they were viewed.
However in the current life of most investors, they do not know of coups, nor that they have generally been conducted with gentlemanly observance of other peoples’ rights. The most recent coup occurred over fifteen years ago, in February 1991. Moreover, a high level of political uncertainty and actual machinations surrounded the September 2006 coup, sufficient to make Machiavelli look almost amateurish. So it was with great relish and some enthusiasm that I thought I should undertake the project of trying to establish what the current view of the foreign business community has been.
I thought that I would take my lead from attitudes of Thailand' English language newspapers. These can be taken to reflect the perceptions of the local and foreign business community, including the foreign business chambers, and Australia and other Western governments.
The effects of those attitude changes are to be measured against the factors below which I have called the “reality”:
• Inward foreign direct investment (FDI), which shows the actual funds being invested in (mainly) capital works, but certainly in ventures in which the capital is not liquid and not very mobile.
• Applications to the Board of Investment (BOI), which is very current and reflects the “up to the minute” thinking of potential investors.
• Actual tourist numbers from Australia.

I will begin with an overview of Thailand focusing on the economy and then discuss exports and imports.
Thailand is a country of approximately sixty-three million people and so provides a large market which offers very good opportunities for business. Thailand is also in the centre of Southeast Asia and we consider ourselves to be the gateway to the Mekong region which is comprised of Myanmar, Laos, Northern Thailand, Cambodia and Vietnam. This region has a total population of about 250 million people. The size of the market is therefore even bigger because Thailand shares borders with all of these countries.
Thailand is also a rising economic star in Asia since we are ranked number two, only after China. Thailand is now the twentieth largest exporter in the world and Thai exports are expected to reach US$100 million in the year 2006. International agencies now view Thailand in a very positive light compared with Thailand during the Asian economic crisis. UNCTAD, for example, has just released a study of Thailand and, in terms of investor confidence and of direct investment from overseas, Thailand is ranked fourth after China, India and the United States.
Turning to the political environment in Thailand, I have seen some one-sided comments from people who have studied Thailand from overseas but who do not really know about Thailand, so I would like to refer briefly to a few issues. Earlier speakers discussed the Thai Government's campaign against drugs and we referred to the killing of many people in Thailand. In fact there are many perspectives on that issue. This government takes drug issues very seriously when compared to the past. They are trying to bring Thailand forward, trying to suppress and trying to uproot the drug syndicates that have been operating behind the scenes for such a long time.

The neurotrophins are growth factors that are involved in the development and survival of neurons. Neurotrophin release by a target tissue results in neuron growth along the neurotrophin concentration gradient, culminating in the eventual innervation of the target tissue. These activities are mediated through trk cell surface receptors. We have determined the structures of the heterodimer formed between brain-derived neurotrophic factor (BDNF) and neurotrophin 4 (NT4), as well as the structure of homodimer of NT4. We also present the structure of the Neurotrophin 3 homodimer, which is refined to higher resolution than previously published. These structures provide the first views of the architecture of the NT4 protomer. Comparison of the surface of a model of the BDNF homodimer with the structures of the neurotrophin homodimers reveals common features that may be important in the binding between the neurotrophins and their receptors. In particular, there exists an analogous region on the surface of each neurotrophin that is likely to be involved in trk receptor binding. Variations in sequence on the periphery of this common region serve to confer trk receptor specificity.

PROBABILITIES AND LIABILITIES
Tort law is deterministic in its view of causal relationships. The basic paradigm is A causes harm to B, with “causes” denoting some fixed, and fully determined (at least ex post), relationship between act and injury. Variants of the model deal with direct and indirect causal connections, the latter sometimes taking bizarre forms as every first year law student learns to his discomfiture upon encountering the subject of proximate cause. But in most cases the underlying assumption is one of determinism: in whole or in part A did or did not cause the harm. Uncertainty is acknowledged, but relegated to issues of proof; probabilities are seen as “evidence” questions, not as part of the fabric of liability rules.
A change in this perspective can be detected, albeit dimly, with the recent emergence of “toxic torts” – including environmental and various products-related harms. The Agent Orange, DES, asbestos cases, to mention only a few prominent disasters of recent years, have made students of tort law more aware of the indeterminacy of causal relationships for many types of modern torts and a growing scholarly literature recognizes the need for tort law to accommodate the probabilistic character of many injuries. The courts for their part have resisted the idea of such an accommodation.
