Since the 1990s, legal consciousness has been amply used by sociolegal scholars to better understand the everyday lives of ordinary people, with a strong focus on vulnerable or impoverished people. This article argues that legal consciousness, with some methodological adjustments, could lend itself to the study of the rich and powerful by investigating both the technical work of their lawyers and how that work shapes our broader legal culture. To illustrate this point, this article takes tax avoidance as a case study. Drawing on materials revealed by a recent tax scandal, it suggests that current difficulty in tackling the problem of tax avoidance rests on uneven access to the cultural repertoires related to legal technique and legal innovation, which fosters the tax-avoidance narrative's ambiguity.

Scholars argue that litigation can have positive and negative “radiating” or indirect effects for social movements, irrespective of formal judicial decisions. They see litigation as a dynamic process with distinctive features yet nonetheless intertwined with advocacy in other forums. Litigation can indirectly shape collective identities, reframe debates, or provide political leverage. However, the mechanisms behind these radiating effects are poorly understood. Through an analysis of lawsuits and related activism by Korean survivors of Japanese actions in the first half of the twentieth century, this article disaggregates the mechanisms behind litigation's productive indirect effects. It theorizes and illustrates mechanisms such as attribution of similarity, brokerage, issue dramatization, political cover, and intergroup discussions. These mechanisms help us understand how litigants obtain litigation's indirect effects and thus also the broader impact of postwar compensation lawsuits in East Asia, despite few judicial victories. The article contributes non-Western and transnational cases to scholarship on litigation's indirect effects.

Based on interviews with 100 members of mixed-status families in Los Angeles, California, this article analyzes how U.S. citizen children practice and understand citizenship in the context of punitive laws targeting their loved ones. Participants' narratives of citizenship as privilege, responsibility, and guilt reveal that despite normative conceptions of citizenship as a universally equal status, citizenship intersects with key social markers to determine the contours and inequalities of substantive citizenship. Specifically, U.S. citizens in mixed-status families make sense of their juridical category when they navigate unrealistic aspirations from relatives, maintain silence about undocumented family members' legal status, manage their fear of family separation through deportation, and take on financial and logistical responsibilities prematurely to help relatives. In each of these ways, family proves to be a key site for the social and relational production of citizenship.

This article explores the realization of the right to access in France, based on biographical interviews with people with mobility or visual impairments. I lay out an original theoretical framework for studying rights realization at the individual level. Although rights activation is the horizon of most rights consciousness research, I argue that rights do not necessarily need to be activated in order to be made real. This realization may also derive from effective policy implementation. In France, however, disabled individuals are very active in realizing their right to access, in a context of insufficient implementation. Moreover, although there is limited collective mobilization, several types of policy feedbacks fuel rights activation and the emergence of grievances regarding the lack of accessibility. Studying the realization of the right to access thus opens up promising perspectives for sociolegal research.

Why do laws become similar across countries? Is the adoption of similar laws and policies due to factors operating independently within each country? Do countries develop similar rules in response to similar challenges? Or is the similarity of laws and policies due to the interdependent responses that scholars have referred to as processes of policy convergence, transfer, and diffusion? We draw on an analysis of immigration and nationality laws of 22 countries throughout the Western Hemisphere from 1790 to 2010, and of seven case studies of national and international policymaking, to show that policies are often interdependent, even in the domain of immigration law, which scholars have presumed to be relatively immune to external influence. We argue that specific mechanisms of diffusion explain the rise of racist immigration policies in the Americas, their subsequent decline, and the rise of an anti-discriminatory norm for policies. Most striking among our findings is that at key junctures after 1940, weaker countries effectively advanced an anti-discriminatory policy agenda against the desires of world powers. We identify the conditions under which weaker countries were able to reach their goals despite opposition from world powers.

The manner in which political institutions convey their policy outcomes can have important implications for how the public views institutions' policy decisions. This paper explores whether the way in which the U.S. Supreme Court communicates its policy decrees affects how favorably members of the public assess its decisions. Specifically, we investigate whether attributing a decision to the nation's High Court or to an individual justice influences the public's agreement with the Court's rulings. Using an experimental design, we find that when a Supreme Court outcome is ascribed to the institution as a whole, rather than to a particular justice, people are more apt to agree with the policy decision. We also find that identifying the gender of the opinion author affects public agreement under certain conditions. Our findings have important implications for how public support for institutional policymaking operates, as well as the dynamics of how the Supreme Court manages to accumulate and maintain public goodwill.

This article examines how the Hague Convention on the Protection of Children and Co-operation in Respect of Intercountry Adoption (Hague Adoption Convention) plays a central role in justifying the institution of legal adoption. The Hague Adoption Convention has often been regarded as a response to the challenges that the “global situation” brings to adoption practice. Based on private international law, the agreement contains protocols and norms to ensure the protection of the child in intercountry adoption. In the article, I propose that the Hague Convention can be understood as a “transparency device”; a complex assemblage working in pursuit of global “good governance.” The device, however, also operates as justification within the institutional domain, allowing adoption agencies to make distinctions between legitimate and illegitimate adoptions. Idemonstrate how the logic of transparency disguises as much as it promises to reveal. While the doctrine's aim is to validate adoptability and combat trafficking, it also helps to mainstream Euro-American adoption knowledge to other parts of the world.

It has become commonplace within disability sociolegal scholarship to argue that, in the last 30 years, a new legal and policy approach to disability has emerged, leading to a paradigm shift from a social protection framework to an antidiscrimination model. Some authors have stressed, however, that the new model has not fully replaced the older social protection approach. Yet little is still known about how the coexistence of these different models impacts on the everyday experience of disability in the workplace and on potential legal mobilization. Based on interviews with workers with disabilities who mobilized the law to obtain reasonable accommodation in Belgium combined with an analysis of evolving Belgian legal schemes relating to disability, this article explores how interactions between social, labor, and antidiscrimination rights shape legal mobilization of persons with disabilities in the workplace. We find that individual's initial self-identification as workers or persons with disabilities influences how they frame their claim and the kind of legal norms they refer to in a first stage but that both their identification and their rights consciousness evolve and change through the course of legal mobilization as they interact with various professionals and navigate between the different concepts and rights available in current law.

How do courts award noneconomic damages? Does it matter if the state is the defendant? This article addresses these questions in the context of medical malpractice appeals to the Spanish Supreme Court. Moreover, this study provides the first empirical analysis of the quantification of noneconomic damages in medical malpractice cases in administrative courts, where the state is the defendant, and in civil courts. This separation of jurisdictions is a common feature in civil law tradition countries. Yet, critics of this separation in general, and specialized courts in particular, argue that parties might be subject to different treatments and that similar cases might reach different outcomes, namely in terms of the quantification of damages. A consistent result of this paper is that no significant differences between noneconomic damages in civil and administrative appeals were found. The separation of jurisdictions does not necessarily imply that courts reach different outcomes, even when the state is the defendant. Citizens should not refrain from bringing their claims forward against the state, a more powerful party. In the current era of increasing juridification and judicialization of modern life (Ginsburg 2009; Hirschl 2006; Hirschl 2011), it is crucial for society that citizens and other parties litigating with the state are not disadvantageously treated.

The process-based model dominates contemporary American research on police-community relations and perceptions of police. A sizable literature has examined the linkages between procedural justice, legitimacy, compliance with the law, and cooperation with police. Less examined is the relationship between legitimacy and public empowerment of police. This study examines this relationship, focusing on police militarization. We first examine the direct effect of legitimacy on public willingness to allow police to become more militarized. Drawing from cognitive psychology and rational choice theories, we then consider indirect paths between legitimacy and empowerment, concentrating on two anticipated consequences of militarization—an increase in police effectiveness and possible harm to civil liberties. Using a national sample of over 700 American adults, and structural equation modeling, results indicate legitimacy has both direct and indirect effects on police empowerment, in part by shaping assessments of the possible consequences of empowerment. Implications for theory and policy are discussed.

Although the conventional wisdom holds that increasing the number of minority officers will enhance residents' perceptions of police and the criminal justice system, further systematic investigation of this hypothesis may be needed. Building on the group-position thesis, the representative bureaucracy theory, and prior research, this study investigates whether perceived minority police presence within residents' neighborhoods affects residents' perceptions of criminal injustice, whether this effect is more pronounced for minority residents and in minority neighborhoods, and whether perceived minority police presence has a stronger effect on perceptions of criminal injustice for minority residents in more integrated and white neighborhoods than minority residents in minority neighborhoods. Analyses of data collected from Los Angeles, CA, show that residents perceive a lower level of criminal injustice when they report that officers in their neighborhoods are not white-dominated, and this finding is not dependent on the respondent's race/ethnicity or the racial/ethnic composition of the neighborhood. In addition, perceived minority police presence seems to have a weak to no effect on residents' perceptions of criminal injustice for Hispanic communities. We discuss these findings and their implications for theory, research, and policy.

Against most male-dominated accounts of professional work, elite law firms in India pose a puzzling exception: women make up about half of these firms, even at senior levels of partnership. Using in-depth interviews with over 130 professionals in India's elite litigation, transactional law, and consulting firms, this research suggests that elite law firms—as new local organizations—aggressively differentiate themselves from their more traditional peers to establish organizational legitimacy. At the same time, as institutions trying to mimic global firms without actual scripts for doing so, these firms engage in a form of “speculative isomorphism” through which they signal meritocracy and modernity to their global audience. Because equal gender representation is one such mechanism, the result is environments where certain kinds of women are uniquely advantaged.

Today, the TASER is a ubiquitous less-than-lethal force technology lauded for its ability to curb police officers' use of excessive and lethal force. Although less injurious than other weapons, concerns exist that the TASER can still be misused by police officers. This article uses ethnographic observations and unstructured interviews across three urban police departments to describe how the TASER affects officers' understanding and use of force in beneficial and unintended ways. I find that officers understand and use the TASER as a device that can enhance safety for themselves and suspects, including in cases where the TASER is used in lieu of lethal force that officers believe would have been justified. Despite these benefits, understanding of the TASER as a safety-enhancing technology also influences the use of excessive force via TASER by young, inexperienced officers, ultimately contributing to the very problem TASERs were intended to ameliorate.

In many countries, the law permits state authorities to detain noncitizens before deportation. Typically judicial decisions about preremoval detention must be made within a short period of time during which deportable noncitizens are held in police premises, and depending on the country detention may last just one month (e.g., France) or up to 18 months (the Netherlands). While previous research has explored various dimensions of noncitizen detention including the legal procedure, health consequences, the condition of detention centers, and the lives of deportable noncitizens, the empirical assessment of the determinants of decisions on preremoval detention are largely unexplored. Using data from court proceedings of police petitions of detention in Spain and a quantitative strategy, in this article we undertake an empirical analysis of noncitizen detention combining personal background of deportable noncitizens, legal factors of the case, and the behavior of different actors involved in the procedure. To do it, we fit models that take into account variation occurred at judicial district levels. Results indicate, on the one hand, that relevant actors involved in the procedure use different informational cues to decide on cases. On the other hand, the role of prosecutors and attorneys during hearings proves also relevant to predict detention.

This study empirically investigates how courts define sexuality of disabled persons in the absence of a formal right to sexuality. The focus of the study is tort law, a field ungoverned by direct disability rights legislation, assuming that tort law is the law of disablement as it concerns the transformative process of becoming disabled. The study investigates the types of damages courts have awarded for harm to sexual functioning, inquiring to whom and under what conditions have they been awarded. Additionally, it examines the discourse that characterizes each type of damages, and the legal, social, medical, and healthcare policy developments that have affected courts' rhetoric and reasoning. Our findings reveal shifting trends in scale, content, and inclusiveness of beneficiaries in terms of gender and age. Over time, courts have adopted a more hopeful and dynamic approach to disabled persons' sexuality while remaining within an individual-medical framework. We suggest that these shifting trends can be linked to the slow diffusion of the social-affirmative approach to disability, the limits of tort law as a field, and the role of healthcare policy in shaping the landscape of tort claims.
