3 - Europeanised Substantive Criminal Law in the Broader Sense (Council of Europe and EU)

Summary

European Criminal Law pursues harmonisation of the national criminal law of the Member States of the EU and of the Council of Europe. As to the latter, lacking the power to enact supranational legislation, this ‘Europeanisation’ of national law is done by the Council's Conventions. However, one can hardly speak of a complete harmonisation. Regarding the EU, the Europeanisation of national law – apart from the Union’s (limited) competence to create supranational criminal law – is mainly brought about by a vast amount of secondary legislation, nowadays in particular directives, aiming at the approximation of national substantive and procedural criminal law and the effective implementation of certain Union policies. Besides that, Union law influences the national law of the Member States in a variety of ways: in a general fashion, through the Member States’ duty of loyal cooperation with the Union and its institutions and through the principles of primacy of Union law and of harmonious interpretation; in a more concrete way, through the assimilation of Union and national interests by way of references in Union primary law to national criminal law and conversely, of (blanket) references to Union law in national criminal laws.
