Summary

Given the diversity of exceptions in national laws, it is impossible for categories of exceptions to be treated comprehensively in this book. This chapter therefore focuses on a comparative legal analysis of the following selected categories of copyright exceptions: temporary or transient copies; quotations; parody or satire; educational uses; and libraries and archives. In addition to these categories, exceptions for ‘news’, political speeches and related exceptions are dealt with in Chapter 8. For each category of exception covered, this chapter introduces the exception, explains how it is dealt with under international copyright law, gives examples drawn from selected national laws and draws conclusions about implications of the exceptions for copyright public domains. In addition to the exceptions covered in this chapter, we deal with two other important categories of exceptions – private use exceptions and exceptions to assist visually impaired and print-disabled people under Marrakesh – in the Online Supplement.
