10 - Civilians in the Hands of a Party to the Conflict

Summary

That other considerable category of detainee, namely civilians in the hands of a party to the conflict, is the subject of Chapter 10. After noting the national level measures that are taken to implement the Geneva Convention obligations, the Chapter considers inter alia such topics as the Manual’s explanations in respect of protected person status, derogation from GC rights and privileges for security reasons, humane treatment, measures of control and security, and the general treatment of protected persons. Removal of such persons from their home territory, internment and a wide range of specific issues concerned with the accommodation, employment and general treatment of internees and the administration of places of internment, with judicial proceedings involving protected persons and with national measures to account for them are then discussed in the Manual and the Chapter comments appropriately on those provisions. The role and rights of the protecting power, deaths of internees and arrangements for their release at the conclusion of hostilities are also addressed. The paucity of references to human rights law and to article 75 of Additional Protocol I in the Manual’s consideration of these topics is also noted.
