This essay explores four key dimensions of political science literature on the U.S. criminal legal system, by way of introducing articles in the special issue on criminal justice featured in the Journal of Racial and Ethnic Politics. We situate police as an institution of social control, rather than providing safety for people vulnerable to crime. The vast array of policy tools to surveil, track, and detain citizens, which lack commensurate restraints on their application, amount to a finely tuned carceral machine that can be deployed against groups newly identified as deviant. We therefore turn attention to this dynamic with our second theme: the criminalization of immigrants, the expansion of interior immigration enforcement, and the consequent targeting of Latinx people. We likewise discuss lessons for reform that can be drawn from research on representation and the political socialization that occurs as a consequence of involuntary contact with the system. We conclude with a brief discussion of directions for future research. The criminal legal system is a key force for persistent racial and class inequality. By turning attention to the politics of the criminal legal system, we forward a critical and understudied facet of American political life that intersects with all corners of the discipline.

This paper traces the centrality of the human face in the construction of modern individuality. It argues that the face of individuality no less than that of typology, is mired in and born of historical and political conditions that are subsequently disavowed in order that the individual (and the face she bears) is rendered a product of nature, an instantiation of the universal. Attempting to denaturalize and defamiliarize the authority invested in the face, this paper maps out three interrelated arguments: that the human face is historically produced; that its history is closely tethered to the production of modern subjectivity, and that its status as a purveyor of meaning relies upon the reiteration of preexisting norms through which it can be “read.” And yet, while this paper turns to the nineteenth century to trace the novel privileging of the face as an extension of selfhood, interwoven through this history is the figure of the “effaced” Muslim woman and the Muslim terrorist type.

This paper provides evidence of racial variation in traffic enforcement responses to local government budget stress using data from policing agencies in the state of Missouri from 2001 through 2012. Like previous studies, we find that local budget stress is associated with higher citation rates; we also find an increase in traffic-stop arrest rates. However, we find that these effects are concentrated among White (rather than Black or Latino) drivers. The results are robust to the inclusion of a range of covariates and a variety of model specifications, including a regression discontinuity examining bare budget shortfalls. Considering potential mechanisms, we find that targeting of White drivers is higher where the White-to-Black income ratio is higher, consistent with the targeting of drivers who are better able to pay fines. Further, the relative effect on White drivers is higher in areas with statistical over-policing of Black drivers: when Black drivers are already getting too many fines, police cite White drivers from whom they are presumably more likely to be able to raise the needed extra revenue. These results highlight the relationship between policing-as-taxation and racial inequality in policing outcomes.

This paper explores the ways in which neoliberal policies enacted by elites across the Northern Triangle have led to increased violence in Central America, a lived experience that continues as individuals migrate to Mexico and the United States. In this work, I examine how neoliberal polices in the region have created limited economic opportunities and means of subsistence for the poor in Central America, as well as the rise of extra-legal actors and criminal enterprises. Together these conditions leave Central Americans with no choice but to migrate north. This paper then explores the violence migrants experience as they move through Mexico. In this stage of the journey, migrant bodies are objectified and then commodified as cheap labor for the global market as well as local economies of violence. Lastly, I discuss the multiple zones of violence that migrants experience at Mexico's border with the United States. This project relies on in-depth, semi-structured interviews (n = 99) with Central American migrants over the course of 4 years (2014–18). Ultimately, I find that for Central American migrants, violence can be a seemingly inescapable reality as neoliberal forces maintain and normalize violence in order to preserve an established social order at the expense of these migrants.

Though African-American and Latino electoral success in state legislative and congressional elections continues to occur almost entirely in majority-minority districts, minorities now have new opportunities in districts that are only 40–50% minority. This success can primarily be explained in terms of a curvilinear model that generates a “sweet spot” of maximum likelihood of minority candidate electoral success as a function of minority population share of the district and the proportion of the district that votes Republican. Past racial redistricting legal challenges often focused on cracking concentrated racial minorities to prevent the creation of majority-minority districts. Future lawsuits may also follow in the steps of recent successful court challenges against racially motivated packing that resulted in the reduction of minority population percentage in a previously majority-minority district in order to enhance minority opportunity in an adjacent non-majority-minority district.

The undocumented youth movement is diverse in terms of race, ethnicity, and immigration status. I argue that racial and immigration status diversity has a direct impact on the movement's ability to “expand the scope of conflict,” that is to say recruiting new members, reaching out to elected officials, and establishing representative leadership—elements that are critical to the sustainability and effectiveness of a movement. Findings also indicate that immigration status diversity plays a complex role. The presence of citizen allies brings both risks and benefits to the movement, as they reinforce the electoral connection sought by elected officials while at the same time jeopardizing the authenticity of the movement. Results are based on field research conducted between 2012 and 2015 in NJ and NY, including participant observation in state-level campaigns and interviews with over 130 immigrant youths, allies, and elected officials. This article contributes to the social movement literature by providing empirical evidence of the challenges present within diverse coalitions. It addresses the question of immigration status diversity, an issue that affects the immigration movement but speaks more broadly to the role of allies in social movements.

Evidence that racial minorities are targeted for searches during police traffic stops is widespread, but observed differences in outcomes following a traffic stop between white drivers and people of color could potentially be due to factors correlated with driver race. Using a unique dataset recording over 5 million traffic stops from 90 municipal police departments, we control for and evaluate alternative explanations for why a driver may be searched. These include: (1) the context of the stop itself, (2) the characteristics of the police department including the race of the police chief, and (3) demographic and racial composition of the municipality within which the stop occurs. We find that the driver's race remains a robust predictor: black male drivers are consistently subjected to more intensive police scrutiny than white drivers. Additionally, we find that all drivers are less likely to be subject to highly discretionary searches if the police chief is black. Together, these findings indicate that race matters in multiple and varied ways for policing outcomes.

Despite the longstanding underrepresentation of blacks in Congress, political science research has not settled on the cause. While there is increasing evidence that racial attitudes affect vote choice in today's congressional elections, how this effect interacts with the race of the candidates is unknown. This study addresses this debate by analyzing novel survey, census, and candidate data from the Obama era of congressional elections (2010–2016) to test whether racially prejudiced attitudes held by whites decrease their likelihood of supporting black Democratic candidates and Democratic candidates as a whole. In line with theoretical predictions, this paper finds that Democratic House candidates are less likely to receive votes among white voters with strong racial resentment toward blacks, and black Democratic candidates fare even worse. These findings help to explain the persistence of black legislative underrepresentation and contribute to theories of partisan racial realignment.

What explains why some Latinos feel strongly tied to their coethnics while others do not? Demographic context is one of the most cited predictors of identity strength, but the size and direction of its effects are disputed. Geographic differences in policy environments may explain the phenomenon. We argue that high levels of immigration enforcement indirectly lead to increased feelings of ethnic linked fate by determining where and how demographic context—in this case, the size of the immigrant population—will be salient. To test this, we combine information from local immigration-enforcement data (obtained via Freedom of Information Act requests) with the Latino Decisions' 2016 Collaborative Multiracial Post-Election Survey. The results suggest native-born Latinos have a stronger sense of ethnic linked fate when they live near large immigrant populations and rates of enforcement are high. When enforcement is low, the presence of immigrants has a negligible effect on native-born attitudes. Foreign-born Latinos' sense of linked fate is unaffected by policy context. These results suggest that as immigration enforcement becomes intensifies, conservative politicians may see increased backlash, at least in certain communities, from native-born Latinos. This is because feelings about ethnic linked fate correlate with increased participation and more proimmigrant policy stances.

One of the long-standing puzzles in the political behavior literature is about immigrants' low level of political participation: after achieving comparable and sometimes even higher levels of socioeconomic status relative to the native-born citizens, why do immigrants still participate less in politics? We argue that the different formative years experiences associated with immigrants who moved to the United States at an older age is the key that explains the participation gap between immigrants and the native-born population. Using the 1994–2016 Current Population Survey and their Voting and Civic Engagement Supplements as data sources, we develop a hierarchical model that simultaneously accounts for region-, country-, and individual-level variables. The results are striking. We show that immigrants who move to the United States at a young age participate in politics at a rate that is indistinguishable from the native-born population; those who migrated at an older age participate less. The fact that over 60% of the immigrant population moved to the United States as adults is a main factor that contributes to the political participation gap between immigrants and the native-born population.

Why are some voters less likely to align with their group when group-based voting is both the norm and advantageous? I argue that the answer to this question can be found in the extent to which individuals are apparently consistent with the prototypical individual in their group. I develop a concept of racial distance, which improves upon the in-group out-group focus of the race and ethnic politics literature. Empirically, I investigate this relationship in South Africa using an original panel survey, which brackets the 2014 national elections. I find that those who are not readily identified as members of their group are less likely to vote with their group and more likely to change their vote due to an election campaign. Analyzing data from the South Africa 2016 the US 2012 elections suggests that this relationship holds for racial majorities but only minorities with a relatively weak sense of solidarity.

Racial fluidity and mixed phenotype have been posited as critical barriers to politicized black identity in the region. Using an original, survey experiment in Panama, this paper finds that racial fluidity and phenotype significantly affect who identifies as black, but have relatively little impact on the strength of measures of black group consciousness. Rather than reducing the strength of group consciousness all together, racial fluidity and phenotype influence the salience of different measures of group consciousness. Afro-Panamanians with phenotypic features that stably predict black self-identification express stronger beliefs that racial discrimination is a problem in Panama (perceived discrimination) and greater dissatisfaction with the social standing of their in-group (polar power). In contrast, Afro-Panamanians with mixed phenotypic features express stronger in-group affect (pride), stronger belief in the efficacy of black collective mobilization (collective efficacy), and stronger linked fate.

A growing body of research suggests that proximal exposure to immigration enforcement can have important social and health-related consequences. However, there is little research identifying the impact of proximal contact with immigration policy on political attitudes and behaviors, and still less investigating the underlying mechanisms that might connect contact and political dispositions. Drawing on insights from criminal justice, we argue that proximal immigration contact influences political behavior via a sense of injustice with respect to the discriminatory application of immigration enforcement. The impact of a sense of injustice should primarily hold among Latinos, who are targeted on the basis of race, ethnicity, accent, and skin color. Nevertheless, it may also hold among Blacks, whose communities are targeted more generally, and Asians, to whom issues related to immigration are likewise important. In order to assess this theory, we leverage a survey with nationally representative samples of four different racial groups. We find that proximal contact motivates participation in protests, and does so indirectly via a sense of injustice for white and Asian respondents. Latino and Black respondents are primarily motivated by injustice irrespective of contact. In sum, the results suggest that immigration enforcement and non-immigration-related criminal justice policies may have similar political effects on those who are proximately affected.

Significant research indicates that attitude change is often a product of partisan learning. However, as the party system continues to rearrange around issues of race and immigration, and as new racial policy issues thrust onto the agenda, it is unclear whether voters learn to adopt racial policy attitudes more based on race/ethnicity or on party identification. We evaluate the partisan-learning model versus a racial-learning model with regards to public opinion on sanctuary cities/policies among survey respondents in CA and TX. Given President Trump's public antipathy toward sanctuary cities, we argue and show that negative partisanship is the most plausible vehicle for sanctuary city attitude change between 2015 and 2017. In this particular case, we find no support for a racial/ethnic-learning model.

Theories concerning the adoption of punitive policies at the state level often cite two dynamics: conservative ideology and racial threat, that punitive policies are more likely in states with Republican politicians and a higher proportion of Black residents. I argue these theories lose their explanatory power in the post-Civil Rights era, and suggest Black political incorporation acts as a powerful antidote to the punitive impulses of government officials. I test my hypotheses on a dataset of state corrections spending from 1983 to 2011 and find evidence for the counterbalancing argument. States with increasing percentages of Black state legislators spend .36 fewer dollars per capita on corrections, suggesting Black political incorporation is an important mediator in the relationship between racial threat and corrections budgets. This paper has implications for the application of the social control theory as descriptive representation grows, but also for the study of the effect of minority politicians on budgets and policy more broadly. The adoption of policies deleterious to certain communities can be mitigated by the presence of representatives who legislate on behalf of those communities.

While popular narratives regarding the destiny of demographics assume Latino interstate migrants will alter destination state politics as Latinos disperse across the states, no studies directly assess the empirical validity of the underlying assumption of migrant's political preferences. Moreover, established theories of domestic migrant preferences suggest a variety of potential individual-level behaviors that often diverge from the underlying assumption of a uniform introduction of more liberal voters. Employing data from the 2016 Collaborative Multiracial Post-Election Survey, this study presents an analysis on Latino interstate migrant voting behavior, while also overcoming a variety of data limitations in existing studies. Countering some previous findings that homophily, adaptation, or even a static liberal orientation describes migrant voting behavior, the results suggest that Latino interstate migrant preferences vary by the political context of their previous state of residence. The results imply that the destiny of demographics will be conditioned, to some extent, by the migratory patterns of Latinos and the dyad of departure and destination states. When Latinos leave liberal (conservative) states, they bring more liberal (conservative) policies. In short, Latinos seem to pack their politics when moving across state lines.

The relationship between religiosity and political attitudes is well established in the United States, particularly around gendered issues like abortion. However, this relationship can be complicated by the highly gendered and racialized nature of social identities. In this paper, we explore how different forms of religiosity (belonging to a denomination, specific religious beliefs, and religious behavior in church and in private) interact with gender to shape Latino abortion preferences. Using two sets of national survey data, we find that Evangelicalism and church attendance are more strongly associated with anti-abortion attitudes among Latino men, while religious beliefs are gender neutral. Our results illustrate the importance of intersectional approaches to studies of social identities and political preferences, as well as the importance of including gender in research on the role of the Evangelical church on immigrant political behavior.

The Catholic Church currently sits at the forefront of U.S. demographic change as a prominent institution that is working on how to positively respond to a growing Latino population. Understanding the factors that either complicate or facilitate that endeavor may help other institutions in their future efforts to likewise integrate and serve Latino communities. Further, there may be broader implications for the success of Catholic churches to serve as research has found that participation in church activities is positively related to increased rates of civic and political engagement. However, these positive effects cannot be felt if churches fail to present the opportunity to participate in the first place. To that end, this study examines the relationship between Latino population density, the presence of a Latino minister, and the likelihood a church would offer Spanish mass or any other service relevant to the Latino community. I find these factors are useful in predicting service provision to a limited degree, and that individual leaders’ initiative and decision making also play a role in determining institutional responsiveness.

A growing body of literature examines how direct or vicarious contact with forms of state surveillance affects political behavior and perceptions of government legitimacy. We develop a new method, Portals, to collect conversations between black residents from highly policed areas in five different U.S. cities between 2016 and 2018. While existing research emphasizes how interactions with the carceral state are alienating and demobilizing, our analysis of these conversations identifies productive ways in which citizens respond to oppressive encounters with police. The political discourses used by Portals participants, we argue, are centered on a logic of “collective autonomy”—given police ignorance, abuses of police authority, and the little political power that residents of highly policed communities have to demand change, many conclude that power is best achieved by strategically distancing from state institutions in the short term while building community power in the long term. Crucially, articulations of collective autonomy transcend the ideological positions of participants and track closely with an ideological tradition in black politics that persists across generations and contexts of state oppression.
