Le CICR et la Revue internationale de la Croix-Rouge rendent hommage au grand poète et sociologue Jean-Georges Lossier qui s'est éteint le 3 mai 2004. Grand défenseur des valeurs humanitaires fondamentales, M. Lossier a pu transmettre sa réflexion sur l'humanitaire au monde entier à travers la Revue, dont il fut le rédacteur en chef pendant plus de vingt ans.

Dans la nuit du 1er novembre 1954, une série d'attentats secouaient trente localités différentes en Algérie, tandis qu'un communiqué du Front de Libération nationale (FLN) révélait l'existence d'une organisation de lutte armée capable de mener des actions coordonnées sur l'ensemble du territoire algérien. Cette «nuit de la Toussaint» allait marquer le début de huit années de luttes fratricides qui devaient conduire à l'indépendance de l'Algérie.

The application of international humanitarian law (IHL) and international human rights law to UN-mandated forces raises many questions. Several of these were discussed by a panel of academic experts, representatives of governments and international organizations, military legal advisors and ICRC lawyers in Geneva on 11–12 December 2003.

The meeting was divided into three sessions. Two were devoted to the application of international humanitarian law, and one to the application of international human rights law to UN-mandated forces, according to the following framework:

– Working session I: General application of international humanitarian law;

– Working session II: Application of the law of occupation;

– Working session III: Beyond IHL: Aspects of the application of international human rights law.

The meeting only addressed the case of UN-mandated operations, whether under UN, national or regional command and control. Multinational forces acting without a mandate from the UN Security Council were not a focus of the discussions.

Le récent avis consultatif rendu par la Cour internationale de justice sur les Conséquences juridiques de l'édification d'un mur dans le territoire palestinien occupé marque une nouvelle étape dans l'examen par la Cour de différents aspects du droit humanitaire. Il s'ajoute à une série d'affaires où la Cour s'est déjà prononcée en matière de droit humanitaire, de manière plus approfondie dans certains cas que dans d'autres, notamment l'affaire du Détroit de Corfou, l'affaire des Prisonniers pakistanais, l'affaire du Nicaragua, ou encore, plus récemment l'avis consultatif de la Cour sur la Licéité de la menace ou de l'emploi des armes nucléaires.

Dans sa séance du 29 avril 2004, l'Assemblée du Comité international de la Croix-Rouge (CICR) a décidé de modifier le Règlement d'accès aux Archives du CICR de 1996 et de réduire les délais de protection de ses archives à 40 ans pour le délai général et à 60 ans pour le délai prolongé: elle ouvre ainsi au public les archives de la période 1951–1965.

Over thirty years ago the International Committee of the Red Cross (ICRC) submitted a report on the reaffirmation and development of the laws and customs applicable in armed conflicts to the 21st International Conference of the Red Cross held in Istanbul. The purpose of that report was to identify legal issues that, in the ICRC's view, warranted a new effort to codify international humanitarian law (IHL). As is well known, almost a decade later, the texts of the two Protocols Additional to the Geneva Conventions were adopted and opened for signature and ratification. Additional Protocol I, among other things, codified rules on the conduct of hostilities, expanded the protection of certain categories of persons and included, among others, wars of national liberation within the scope of international armed conflict. Protocol II, although more ambitiously envisaged at the start, elaborated on the provisions of Article 3 common to the Geneva Conventions and laid down basic safeguards that must be applied in non-international armed conflicts.

On 29 April 2004, the ICRC Assembly decided to modify the Rules governing access to the archives of the ICRC of 1996 by shortening the protective embargo on access to its archives to a general period of 40 years and an extended period of 60 years. It is therefore now opening its 1951–1965 archives to consultation by the general public.

Il y a trente ans, le Comité International de la Croix-Rouge (CICR) a présenté un rapport sur la « réaffirmation et le développement des lois et coutumes applicables aux conflits armés » à la 21e Conférence internationale de la Croix-Rouge qui se tenait à Istanbul. Le but de ce rapport était d'identifier les questions juridiques qui, de l'avis du CICR, justifiaient un nouvel effort pour codifier le droit international humanitaire (DIH). Comme on le sait, près d'une décennie plus tard, les textes des deux Protocoles additionnels aux Conventions de Genève ont été adoptés et ouverts à signature et ratification. Le Protocole additionnel I, entre autres, codifiait les règles relatives à la conduite des hostilités, élargissait la protection de certaines catégories de personnes et faisait entrer, notamment, les guerres de libération nationale dans le périmètre des conflits armés internationaux. Le Protocole II, bien qu'envisagé dès le début de manière plus ambitieuse, développait les dispositions de l'article 3 commun aux Conventions de Genève et fixait des garanties de base à appliquer lors des conflits armés non internationaux.

The 2003 Law on Serious Violations of International Humanitarian Law was promulgated on 5 August 2003, published on 7 August 2003 and entered into force on the same date. It abrogates the 1993 Law on the Punishment of Serious Violations of International Humanitarian Law and introduces its content into other laws. The law of 5 August 2003 and the substantial changes it brings about were described in the previous Biannual update of January — June 2003.

La Revue internationale de la Croix-Rouge entend favoriser la réflexion sur le droit, la politique et l'action humanitaires dans les conflits armés et autres situations de violence armée collective. Publication spécialisée sur le droit humanitaire, elle cherche à promouvoir la connaissance, l'examen critique et le développement de ce droit et à contribuer à la prévention des violations des règies protégeant les droits et les valeurs fondamentaux. La Revue est aussi une tribune de débat sur l'action humanitaire contemporaine et elle stimule l'analyse des causes et des caractéristiques des conflits, ce qui permet de mieux comprendre les problèmes humanitaires qui en découlent.

The aim of the International Review of the Red Cross is to promote reflection on humanitarian law, policy and action in armed conflict and other situations of collective armed violence. A specialized journal on humanitarian law, it endeavours to promote knowledge, critical analysis and development of this law and to contribute to the prevention of violations of rules protecting fundamental rights and values. The Review also offers a forum for discussion on contemporary humanitarian action and for analysis of the causes and characteristics of conflicts so as to give a clearer insight into the humanitarian problems they generate.
