Juvenile Justice System, Reforms and Policing System in India: Origin, Dialectics, Comparisons, and Way Forward

Abstract

This article studies the juvenile justice system in juxtaposition to policing in India. To start with, it conducts a comprehensive data analysis of juvenile crimes in India in the last two decades. The author conducted a study involving 400 juveniles in conflict with the law through “Disha,” a project in juvenile re-entry systems. It further marshals the incidences based on social parameters like education, age, and family. Here, the paper impresses upon the “heinousness factor” of the crimes to evaluate the law and institutional response. The article examines the growth of the legal framework on juvenile justice in India and the causal determinants which may have driven its increase. It also scrutinizes the policing systems as far as the legal framework on juvenile justice makes them responsible. It delves deeply into the interactions between juvenile justice and police systems at the institutional and procedural levels. It conducts a detailed inquiry into the international legal framework of juvenile justice systems. Here, it studies such systems in the Americas, Europe, and Asia to suggest the way forward for a transparent, robust and sensitive juvenile justice system in India.

Para empezar, lleva a cabo un análisis de datos exhaustivo de los delitos cometidos por menores en la India en las últimas dos décadas. El autor realizó un estudio en el que participaron 400 menores en conflicto con la ley a través de “Disha”, un proyecto sobre sistemas de reingreso de menores. Además, ordena las incidencias en función de parámetros sociales como la educación, la edad y la familia. Aquí, el trabajo incide sobre el factor atrocidad de los crímenes para evaluar la ley y la respuesta institucional. El artículo examina el crecimiento del marco legal sobre justicia juvenil en la India y los determinantes causales que pueden haber impulsado su aumento. También examina los sistemas policiales en la medida en que el marco legal sobre la justicia de menores los hace responsables. Pour commencer, il effectue une analyse complète des données sur la criminalité juvénile en Inde au cours des deux dernières décennies. L’auteur a mené une étude portant sur 400 mineurs en conflit avec la loi par le biais de « Disha », un projet sur les systèmes de réinsertion des mineurs. Il regroupe en outre les incidences en fonction de paramètres sociaux tels que l'éducation, l'âge et la famille. Ici, l’article insiste sur le facteur odieux des crimes pour évaluer la loi et la réponse institutionnelle. L’article examine la croissance du cadre juridique sur la justice pour mineurs en Inde et les déterminants causaux qui ont pu conduire à son augmentation. Il scrute également les systèmes de police dans la mesure où le cadre juridique de la justice des mineurs les rend responsables. Il approfondit les interactions entre la justice pour mineurs et les systèmes de police aux niveaux institutionnel et procédural.
