Re:
I enclose my report and invoice. I respectfully refer you to my Terms and Conditions and remind you that payment is required within … weeks/ months.
Insofar as I have made recommendations as to treatment, please advise the claimant's general practitioner/private doctor or take steps to ensure that the general practitioner/private doctor is so informed. If, for whatever reason, my recommendations are not communicated to the general practitioner/private doctor you must advise me so that I can decide whether or not, having regard to my duty as a doctor, I have an overriding obligation to communicate with the general practitioner. This may be particularly likely if I have made a diagnosis of which the general practitioner is unaware, recommended treatment if the claimant is not having treatment or recommended different treatment to that which the claimant is having.
In accordance with ‘The Protocol for the Instruction of Experts to Give Evidence in Civil Claims’:
1 Advise me as soon as reasonably practicable whether, and if so when, the report will be disclosed to other parties; and, if so disclosed, the date of actual disclosure (14.1)
2 If my report is to be relied upon, and if I am to give oral evidence, give me the opportunity to consider and comment upon other reports within my area of expertise and which deal with relevant issues at the earliest opportunity (14.2)
3 Inform me regularly about deadlines for all matters concerning my role as an expert. This includes promptly sending me copies of all court orders and directions which concern my obligations (7.5)
4 Keep me updated with timetables (including the dates and times I am expected to attend) and the location of the court (19.21b)
5 Keep me informed of the progress of the case, including amendments to statements of case relevant to my opinion (14.3).
6 If you become aware of material changes in circumstances or that relevant information within your control was not previously provided to me, you should without delay instruct me to review and, if necessary, update the contents of my report (14.4).
