  • Conflicts over the employment status of Uber, Lyft, and other gig workers have made headlines in recent years. I argue that the conditions facing these workers and other independent contractors today are in many respects the result of policy decisions made seventy-five years ago, in hard-fought battles over which workers would—and which would not—be protected by New Deal social programs and labor laws for employees. In 1947–48, New Deal Democrats were poised to establish a more expansive definition of “employee,” extending eligibility to a range of workers excluded by more restrictive common law standards. The Republican-led 80th Congress thwarted the attempt to expand coverage, however, by blocking administrative initiatives, reversing court rulings, and redefining employment-based eligibility for federal labor and social protections. Their actions redirected policy on employment relations, restricting the reach of New Deal protections in the post–WWII economy and shaping the terms of subsequent conflicts over employment status in ways that have left broad power and discretion in the hands of employers.

  • This article examines the state of the English-language peer-reviewed literature published over the 2011–2021 period whose objective is to describe and explain processes of development of Canadian public policies and their consequences. It first presents a profile of the surveyed literature's attention to different policy sectors, elements of public policy, and its chosen methodologies to study them. It then examines the empirical and theoretical contributions of the literature to uncovering the constitutive actors and their interactions in policy processes in policy domains of Canadian jurisdictions; the logics of chosen policy instruments and their distributive effects; and the interactions among Canada's structural, institutional and ideational features and policy actors’ motivations and behaviour with processes of policy innovation, continuity and change. A foremost contribution of Canadian policy studies to comparative policy studies is to demonstrate the causal impacts of the interaction of institutional, structural and ideational/cultural factors on processes of policy development.

    Chapter 1 presents the theoretical framework used throughout the book. We argue that the federalist system creates varying layers of inequality for women in their human security. We argue that it is crucial that we understand how and under what circumstances domestic violence policies are adopted so that we can better assess what the laws are intended to fix and how reformers can utilize these pathways in the future to address domestic violence. We provide an overview of the scholarship on federalism as well as descriptions of domestic violence offenses, the rates of domestic violence , and a roadmap for the rest of the book.

  • Summary

    Chapter 2 presents the federal response to violence against women. We begin the chapter with a brief overview of the history of domestic violence in the United States. We then analyze the response of Congress to the domestic violence epidemic as compared to the Supreme Court’s response. This detailed presentation reveals the gaps that federal laws havr created by leaving states the option to enforce them and relegating nearly all of the enforcement of domestic violence law to local authorities. This chapter underscores the role and limi, of federal policy in remedying the inequities among women in their personal protection from domestic violence. The lack of a cohesive federal response contributes to all four levels of gender inequality in domestic violence policy.
