1. Within the commentary on Art. 6(1) of the Brussels Convention Kropholler, for example, discusses the judgment of the Hague Court of Appeal from 23 April 1998 (NJKort 1998, 58).

2. The 1996 Accession Convention is, at the moment of writing of this review, already in force between the following countries: the Netherlands; Germany; Austria; Denmark; Finland; Italy; and Sweden.

3. The opinion of the Attorney-General has already been published in June 1997.

4. In accordance with the German Code of Civil Procedure, the jurisdiction of the courts seized is an allgemeine Prozessvoraussetzung (a condition to continue legal proceedings). If the Prozessvoraussetzungen are not fulfilled the court has no jurisdiction (Baumbach, A. et al. , eds., Zivilprozessordnung mit Gerichtsverfassungsgesetz und anderen Nebengesetzen, 49th edn. (Munich, Beck 1991) para. 253, 3 E (p. 748)).Google Scholar
