The procedure in Rule 61 is not a trial in absentia, which is not formally provided for by Tribunal's Statute, under which every accused has the right to attend his trial; moreover, Rule does not allow for a determination of the accused's guilt and it thereby follows that the Trial Chamber cannot pronounce any sentence.
