1. Dit geldt niet meer voor het delictenrecht. In vrijwel alle Afrikaanse landen is thans een uniform strafwetboek van kracht, incestai van westerse herkomst. Dit strafrecht heeft te gelden voor alle bevolkingsgroepen binnen het staats-verband en moet ook worden toegepast door niet-juridisch geschoolde rechters. Zowel de justiciabelen als een groot aantal rechtstoepassers staan hier nogal cens voor onbegrijpelijke zaken met velerlei consequenties voor het Recht en de rechtvaardigheid.
