Pour être respecté, le droit international humanitaire (DIH) a besoin de mécanismes de mise en œuvre. La plupart sont connus et ont fait leur preuve, qu'il s'agisse de moyens préventifs, de contrôle ou de répression. Ils ont cependant leurs limites et en ce sens la Commission intemationale d'établissement des faits prévue à l'article 90 du Protocole I comble une lacune.
