  • For the vast majority of us salary is one of the key reasons we work. With bills to pay and mouths to feed we want to know we are being fairly compensated for the jobs we do. One way to check this is to use the BIALL Annual Salary Survey which considers not only salaries but also working conditions and benefits, offering a comparison to similar organisations and roles. In this article Julie Christmas, Claire Mazer and the team from CB Resourcing highlight some of the findings from the 2023 survey and consider the reasons behind these.

  • “Constitutional values” is a term which appears to relate to concepts of what is now called public law. By constitutional values, I mean the basic ideas and interests which structure relations between the individual and the state, and the obligations to which they give rise, which underlie the common law and to which it gives recognition in more or less articulated forms. These are ideas and interests such as liberty, private life, freedom of expression and access to justice. Constitutional values and human rights overlap, but they are not necessarily and always the same, either in content or in effect. In exploring this topic I hope to retrieve and bring to the surface an important aspect of the common law in terms of both private law and public law.

  • Fragmentation is currently discussed mainly in the context of international law; this book shows that the complexity of regulations and multiplicity of institutions in a non-hierarchical order lead to fragmentation in national legal systems as well as in international law. However, the aim of the book is not merely to describe contemporary fragmented law, but rather to offer arguments for strengthening the systemic character of law. The book explores methods of pro-systemic interpretation, the principle of proportionality, legal pluralism, and these analyses result in the conception of normative coherentism. While the vast majority of scholarship associates coherentism with epistemological issues, such as the coherence theory of truth, this work emphasises the importance of an approach to law that focuses on the underlying principles and doctrines that form its foundations, as well as the connections between the various elements of the legal system that need to be discovered through the doctrinal study of law. The axiological, not axiomatic, nature of law, complexity theory and common foundations of simultaneously applicable legal systems are described as the basic premises of normative coherentism. The author outlines manifestations of normative coherentism in various processes in law, especially in law- and decision-making.

  • Summary

    The right to respect for family life is one of the most important and closely protected rights that children possess. It is widely recognised that loving, secure and stable relationships with trusted carers are fundamental to a child’s well-being and development. Family relationships are also vital to a child’s sense of identity and place in the world. Despite the importance of the right to family life, its application in practice can undermine the very relationships that it seeks to protect. The mutual nature of the right to family life means that it is particularly susceptible to attempts by adults to clothe their own interests in the language of children’s rights. This chapter explores the right to family life and the extent to which it protects biological relatedness, legal parenthood and practical relationships of care and responsibility. Particular attention is given to child arrangements disputes, adoption and post-adoption with birth families.
