PART TWO - LEGAL FRAMEWORKS AND ALTERNATIVES
Published online by Cambridge University Press: 14 September 2019
Summary
Given the obvious life-saving importance of the issue, the principal options available are to reduce demand, to increase supply, and/or to develop alternatives.
Jack KressPart II of this book examines existing legal frameworks for organ procurement and analyzes alternative transplantation mechanisms. This section describes the Uniform Anatomical Gift Act and the recent efforts by the National Conference of Commissioners on Uniform State Laws (NCCUSL) to retool the Act, which was last amended in 1987. This section also scrutinizes two methods for increasing the organ supply: presumed consent and commoditization of body parts. I analyze the relative value and drawbacks of both models, primarily focusing on the value of these models to vulnerable populations.
