  • The Islamisation of the English Trust: The Hibah Trust in Malaysia

  • Malaysia, being a former English colony, inherited a corpus of English law which includes equity and trusts. In recent times, major banks, financial institutions, and trust companies have reimagined the English trust in combination with Islamic law, by offering an innovation called the hibah trust. This instrument represents the Islamisation of the English trust concept where the Islamic idea of the hibah, an inter vivos gift and the English trust is combined as a wealth management offering to clients. This article explores how the hibah trust works, reasons why institutions may be offering this hybrid instrument, and potential challenges to its validity both in the civil and Syariah court.

    High net-worth (and sometimes high-profile) families in Singapore continue to face internal disputes. These disputes sometimes lead to litigation about matters relating to trusts, estates, family companies and, increasingly, mental capacity issues. This paper will discuss some recent developments in Singapore in relation to family wealth disputes. They will particularly consider cases relating to mental capacity, jointly owned property and family businesses and companies.

  • There has been insufficient literature focusing on the world-changing rise of Asian wealth. Private wealth in Asia is very substantial, with 33 per cent of the global population of high-net-worth individuals based in Asia. Yet, there is a dearth of legal analysis of Asian wealth, particularly by texts written in English. This collection aims to fill that gap, with chapters on legal issues in relation to Asian wealth transmission, investments in international real estate, familial disputes, family offices and private trust companies. A substantive section of this book also focuses on the changing legal context with chapters exploring trusts and cryptoassets, constructive trust, trustee's discretion and decision-making, changing regulatory environment and abuse of trust structures. This collection of essays on trusts and wealth management presents a focus on Asian wealth and the changing legal context, and follows the related publication, Trusts and Modern Wealth Management (Cambridge University Press, 2018).

  • Viruses completely rely on the energy and metabolic systems of host cells for life activities. Viral infections usually lead to cytopathic effects and host diseases. To date, there are still no specific clinical vaccines or drugs against most viral infections. Therefore, understanding the molecular and cellular mechanisms of viral infections is of great significance to prevent and treat viral diseases. A variety of viral infections are related to the p38 MAPK signalling pathway, and p38 is an important host factor in virus-infected cells. Here, we introduce the different signalling pathways of p38 activation and then summarise how different viruses induce p38 phosphorylation. Finally, we provide a general summary of the effect of p38 activation on virus replication. Our review provides integrated data on p38 activation and viral infections and describes the potential application of targeting p38 as an antiviral strategy.

  • Summary

    Persons with special needs are in an extremely vulnerable position where they are potentially subject to financial abuse by rogues. Unfortunately, policy makers and scholars have not given this problem sufficient consideration. Drawing from the Singapore experience, this chapter explores the financial planning mechanisms available to persons with special needs which currently exist through legislation and various government and non-profit initiatives. It then considers several case studies of financial abuse of persons with special needs to expose the potential systemic weaknesses in the current regime. The aim of the chapter is to provoke a conversation on how societies can do better by enacting laws and implementing schemes to prevent financial abuse of persons with special needs.

  • Summary

    A Beddoe order is a pre-emptive cost order which authorises trustees to pursue or defend a court action. Once the order is granted, the trustees would be indemnified from the trust fund in relation to the legal costs incurred even if the trustees are ultimately unsuccessful in the legal proceedings. Under orthodox trust law, the court will generally not grant such a pre-emptive cost order in favour of beneficiaries. This chapter challenges this orthodoxy. The thesis of this chapter is that in appropriate circumstances and consistent with the philosophy of ensuring that the trust is properly governed, the court should similarly invoke its inherent jurisdiction and grant a Beddoe order in favour of beneficiaries who are instituting a suit against trustees for a breach of trust. The argument in this chapter is that the guiding principle should be whether the grant of such an order would be in the best interest of the trust estate. Without the benefit of a Beddoe order, there is the real danger that such legal actions may end up being thwarted due to a lack of funding.
