1. Este período, que comienza a principios de la segunda mitad del siglo XIX, se caracteriza por el inicio y el desarrollo —que luego se intensificará, en gran medida, tras la Segunda Guerra Mundial— de la codificación internacional del derecho de la guerra, el cual ya no será, como hasta entonces, exclusivamente consuetudinario.

El documento que marca el verdadero comienzo de la afirmación de los nuevos principios de civilización y de humanidad en la conducción de las hostilidades es un reglamento interno que, gracias al valor intrínseco de sus disposiciones, ejerció considerable influencia sobre la adopción de normas análogas por otros Estados y sobre la elaboración de normas correspondientes en el derecho internacional.
