Summary

Comparisons of judges by political orientation (within each of these chapters) and comparisons across the chapters (between criminal prosecutions, courts, martial, military commissions, habeas corpus, civil damage actions and civil liberties) reveal when courts do and do not preserve basic rule of law principles in the context of the "war on terror." An analysis of more than a hundred other instances suggests that a generation may have to elapse before societies confront and redress major social wrongs.
