Editorial note
The objective of the Protocol on Pollutant Release and Transfer Registers is to enhance public access to information through the establishment of coherent, integrated, nationwide pollutant release and transfer registers (PRTRs) which could facilitate public participation in environmental decision-making and contribute to pollution prevention and reduction (Article 1). Parties shall be guided by the precautionary approach in implementing the Protocol (Article 3(4)). Each Party shall establish and maintain public accessible national PRTRs (Article 4). Parties shall ensure that data held in PRTRs is presented in both aggregated and non-aggregated forms (Article 5). The registers shall include information on releases of pollutants, off-site transfers and releases of pollutants from diffuse-sources (Article 6). Article 7 contains provisions on reporting requirements which are imposed upon the owners or the operators of facilities undertaking activities specified in annexes to the Protocol or operators or owners of facilities whose activities are above specified thresholds (Article 7(1)). The owners or operators of facilities required to report shall submit the information on pollutant release and transfer specified by Article 7(5)(a) to (f). Owners and operators are required to collect data and keep records (Article 9). Owners and operators shall assure the quality of the information that they report (Article 10). Parties shall ensure public access to information contained in PRTRs without an interest having to be stated (Article 11). Confidential information may be withheld from the public (Article 12).
