Summary
Wenn in Rom anfänglich in der Person des Königs Amt und Priesterthum zur Einheil verschmolzen gewesen sind, so ist zwischen der Magistratur und dem Priesterthum der Republik die Grenzlinie mit römischer Schärfe gezogen. Der gesammte vorschriftmässige Cultus der von der Gemeinde anerkannten Gotter ist den Priestern überwiesen, ohne dass den Beamten irgend ein Antheil dabei) oder auch nur ein Oberaufsichtsrecht eingeräumt wäre; die Vertreter der Gemeinde haben als solche wohl für die Stadt das einem jeden Bürger für sich zukomniende Recht nach Bedürfniss zu beten und zu opfern, zu geloben und zu weihen, aber auch eben nur dieses. Umgekehrt sind in dem Gemeindewesen die Priester als solche ohne formelle Gewalt) und ohne rechtliche Stellung); sie sind zwar aneewiesen das Wohl der Gemeinde wie des Einzelnen durch Rathschlag und Warnung nach Vermögen zu fördern, aber sie haben keine äussere Gewalt ihren Spruch zwangsweise zur Geltung zu bringen. — Dem entsprechend ist auch die Organisation der Priesterschaft und der Magistratur in den wesentlichsten Principien diametral entgegengesetzt. Wie der Magistrat nothwendig auf Zeit eintritt, so ist das Priesterthum mit verschwindenden durch die besondere Beschaffenheit des Gultus gebotenen Ausnahmen lebenslänglich oder wenigstens nicht jährig).
