Summary
Keine römische Magistratur hat in gleichem Grade wie die Aedilitat ihre anfängliche Geltung späterhin verändert, und bei keiner liegt daher die ursprüngliche Bedeutung so im Dunkel wie bei ihr. Obwohl die verbindenden Fäden natürlich nicht gefehlt haben, ist dennoch die Aedilität derjenigen Epoche, wo die plebejische Gemeinde selbständig neben der patricischen stand, eine vollig andere Institution als die Aedilitat der ver-einigten patricisch-plebejischen Gemeinde; und während wir die spätere Aedilität durch gleichzeitige Berichterstatter hin-reichend kennen lernen, finden wir uns filr die erstere an-gewiesen auf zweifelhafte Rückschlüsse und auf sogenannte Zeug-nisse, die vermuthlich selbst zum grossen Theil auf Rückschlüssen aufgebaut und somit wo moglich noch zweifelhafter sind. Es wird angemessen sein beide Institutionen, so weit dies irgend moglich ist, von einander abgesondert zu behandeln.
Die Aedilität der älteren pleljejischen Gemeinde.
Alle Berichte stimmen darin überein, dass die Einsetzung der plebejischen Aedilität mit der Gonstituirung der Plebs selbst und des Tribunats derselben zusammenfallt oder, was dasselbe ist, dass die Plebs, als sie sich als politische Körperschaft orga-nisirte, sich in dem Tribunat und der Aedilitat eine doppelte Vorsteherschaft gab). Ist jenes, wie wir fanden (S. 248), eine Nachbildung des patricischen Consulats, so erscheint in noch ent-schiedenerer Weise die plebejische Aedilität als Nachbildung der patricischen Quästur.
