Summary
Mit der Abschaffung des Königthums und der Einführung der Republik tritt an die Stelle des, Herrschers ‘der, Feldherr‘, der praetor; denn praetor ist prae-itor, der Heerführer. Dafür, dass dies die ursprüngliche Bezeichnung sei, spricht ausser der Analogie des diesera Oberbeamten correlaten und vermuthlich mit ihm zugleich eingesetzten Hülfsbeamten, des quaestor, insbesondere, dass in den latinischen Städten die Oberbeamten durchgängig diesen Namen führen und dass die zwölf Tafeln keine andere Benennung als diese gebraucht zu haben scheinen. Vielleicht hängt das Hervorheben der militärischen Seite des Amts damit zusammen, dass fortan der Gemeindevorstand nur im Krieg, nicht im Frieden regiwn imperium haben sollte.
Dieser älteste Amtstitel haftete, wie natürlich, an dem Collegium der Oberbeamten als solchem. Er umfasst daher von Anfang an den Dictator mit, da dieser, wie seiner Zeit gezeigt werden soil, College der Consuln ist; doch hat derselbe die Benennung als Titel nie gebraucht, obwohl er correct als praetor maximus bezeichnet werden konnte. Als späterhin in dem obersten Collegium andere Stellen für Beamte minderen Rechts geschaffen wurden, übertrug sich die Benennung mit rechtlicher Nothwendigkeit auch auf diese; und seitdem gab es zwei Galtungen von Prätoren, maiores und minores.
