  • Summary

    The optimal size of government for the provision of public services is a question almost as old as the institution of government itself. One answer to the question is that government needs to be big enough to ensure that it can be both autonomous and self-sufficient. Another answer is that government needs to be large enough to capture efficiencies in service production. Neither answer is wholly satisfactory, in large part because they fail to specify how the common good is to be balanced against the need to preserve human dignity. In this chapter I first review the problems with extant arguments relating to the optimal size of government for public service provision before turning to a potential resolution to the problem which puts the person at the center of the quest for optimal local government. I then examine the most commonly executed reforms employed to alter the size of local governments before considering some public policy alternatives that might be more in keeping with an attempt to balance the common good against human dignity.

  • Sous son aspect positif, la marge d’appréciation que la Cour européenne des droits de l’homme reconnaît aux États permet à ceux-ci d’enrichir le socle des droits fondamentaux établi par la Convention européenne des droits de l’homme. Elle met en avant la responsabilité de chaque État dans la concrétisation de la Convention. Elle contribue alors au développement de la démocratie qui croît avec le renforcement des droits de l’homme. Sous son aspect négatif, l’invocation de la marge d’appréciation permet à la Cour d’absoudre certains États alors que ceux-ci sapent le socle des droits fondamentaux. Elle s’y sent contrainte pour amadouer les États qui contestent son autorité au nom de leur autonomie. Question de survie donc ou à tout le moins de préservation de son rôle unificateur. Le réalisme politique l’emporte alors sur les exigences démocratiques.

    As the nature of poverty changed significantly from the medieval to the modern and contemporary periods, so also has natural law reflection on poverty. This chapter begins with an exposition of the basic lines of Thomas Aquinas's natural law ethic, particularly as it was applied to poverty, and provides a brief explication of one of this tradition's most important early modern advocates, Bartolomé de Las Casas, O.P. It also examines the work of John Finnis, one of the founders of the "new natural law theory", and the use of his theory by a development economist, Sabina Alkire. Natural law approaches responsibility for domestic poverty in terms of three principles: the principle of solidarity, the principle of subsidiarity, and the principle of the common good regarding the state as ultimately responsible for promoting the public good when other agencies fail to do so.
