In 2017, the Taiwanese Constitutional Court handed down Judicial Yuan Interpretation No. 748, which was a ruling in favour of same-sex marriage. The Court also ordered the national legislature to amend the law within two years. Despite a significant backslide in the Taiwanese 2018 referendum, the legislature eventually followed the Court’s order and legalized gay marriage in 2019. This victory made Taiwan the first state to legalize same-sex marriage in Asia. Many legal scholars consider the same-sex marriage ruling a progressive decision in which the Court undertook a counter-majoritarian task of protecting a minority group. While we agree with the Court’s role in promoting marriage equality, we contend that most legal scholars overlook an important question in this dynamic: the legislature had had several chances to settle this issue over the past decades, so why did it refuse to draft gay-marriage legislation but later, in 2019, defer to the Court’s decision? In this paper, we explain the political foundations of an activist judiciary by using the case of the first gay-marriage legislation in Asia. We argue that the risk of position-taking on tough issues leads incentive-facing political elites to engage in position avoidance and to see the political value in deferring to a high court’s ruling. Using original data, we present evidence of how Taiwan’s diverse constituency relative to the same-sex marriage issue influenced legislators’ position-avoidance behaviour and led them to dodge political backfire by delegating policy-making authority to the Constitutional Court.

Unobserved heterogeneous treatment effects have been emphasized in the recent policy evaluation literature (see, e.g., Heckman and Vytlacil (2005, Econometrica 73, 669–738)). This paper proposes a nonparametric test for unobserved heterogeneous treatment effects in a treatment effect model with a binary treatment assignment, allowing for individuals’ self-selection to the treatment. Under the standard local average treatment effects assumptions, i.e., the no defiers condition, we derive testable model restrictions for the hypothesis of unobserved heterogeneous treatment effects. Furthermore, we show that if the treatment outcomes satisfy a monotonicity assumption, these model restrictions are also sufficient. Then, we propose a modified Kolmogorov–Smirnov-type test which is consistent and simple to implement. Monte Carlo simulations show that our test performs well in finite samples. For illustration, we apply our test to study heterogeneous treatment effects of the Job Training Partnership Act on earnings and the impacts of fertility on family income, where the null hypothesis of homogeneous treatment effects gets rejected in the second case but fails to be rejected in the first application.

Under a Mundlak-type correlated random effect (CRE) specification, we first show that the average likelihood of a parametric nonlinear panel data model is the convolution of the conditional distribution of the model and the distribution of the unobserved heterogeneity. Hence, the distribution of the unobserved heterogeneity can be recovered by means of a Fourier transformation without imposing a distributional assumption on the CRE specification. We subsequently construct a semiparametric family of average likelihood functions of observables by combining the conditional distribution of the model and the recovered distribution of the unobserved heterogeneity, and show that the parameters in the nonlinear panel data model and in the CRE specification are identifiable. Based on the identification result, we propose a sieve maximum likelihood estimator. Compared with the conventional parametric CRE approaches, the advantage of our method is that it is not subject to misspecification on the distribution of the CRE. Furthermore, we show that the average partial effects are identifiable and extend our results to dynamic nonlinear panel data models.

We propose a test for a generalized regression monotonicity (GRM) hypothesis. The GRM hypothesis is the sharp testable implication of the monotonicity of certain latent structures, as we show in this article. Examples include the monotonicity of the conditional mean function when only interval data are available for the dependent variable and the monotone instrumental variable assumption of Manski and Pepper (2000). These instances of latent monotonicity can be tested using our test. Moreover, the GRM hypothesis includes regression monotonicity and stochastic monotonicity as special cases. Thus, our test also serves as an alternative to existing tests for those hypotheses. We show that our test controls the size uniformly over a broad set of data generating processes asymptotically, is consistent against fixed alternatives, and has nontrivial power against some ${n^{ - 1/2}}$ local alternatives.

We used x-ray diffractometry (XRD), x-ray photoelectron spectrometry (XPS), and secondary-ion mass spectrometry (SIMS) to investigate the mechanism of the interfacial room-temperature (RT) chemical reaction between cation-deficient La0.56Li0.33TiO3 solid electrolytes and metallic lithium anodes in all-solid-state lithium batteries. A stoichiometric mixture of La2O3, Li2CO3, and TiO2 powders was calcined at 1250 °C for 8 h to obtain a single perovskite structure of La0.56Li0.33TiO3. When this La0.56Li0.33TiO3 sample and lithium were placed in contact at room temperature for 24 h, the phase of the La0.56Li0.33TiO3 remained unchanged. The XPS results indicate that 12% of the tetravalent Ti4+ ions were converted into trivalent Ti3+ ions. The valence conversion and degree of conversion were limited by the structural rigidity of the host crystal. Our SIMS analysis suggests the existence of a local electric field near the contact surface and indicates that the 6Li+ isotope ions were inserted into the specimen through the effect of this field. The change in the electrical properties of La0.56Li0.33TiO3 supports this mechanism for the interfacial reaction. The ionic conductivities of the grain and total grain boundary decreased and increased, respectively, after the insertion of Li+, and the total electronic conductivity increased as a result of the presence of intervalence electron hopping between mixed Ti3+/Ti4+ states. The mechanism of the lithium-activated RT interfacial reaction is associated with the reduction of Ti4+ transition metal ions from tetravalent to trivalent states and the local-electric-field-induced Li+ insertion into La3+/Li+-site vacancies of La0.56Li0.33TiO3.

The drift of PECVD TEOS etch rate has been observed during MERIE oxide etch for damascene process. Etch rate typically fluctuates between 5300 Å/min. and 6000 Å/min. depending on chamber condition. Studies using fluorocarbon based chemistry show high TEOS etch rate when chamber wall is heavily coated with polymer deposition. Low etch rate appears when chamber has less deposition. Hysteresis behavior has been observed in TEOS etch rate and emission intensity trends ofF and CFx (x = 1 ∼ 3). From the correlation between etch rate and emission intensity, a model is proposed to explain the impact of chamber wall polymer deposition on TEOS etch rate. It clearly shows that F is directly responsible for the etch of TEOS. Comparing to F, CFx plasma chemistry has a closer link in chamber wall polymer formation, but less contribution in the etch of TEOS.
