  • Trans Rights Are Not Just Human Rights: Legal Strategies for Trans Justice

  • Human rights instruments are but one of many legal advocacy tools used by trans people. Recent legal scholarship emphasizes that human rights laws are not sufficient to address legal challenges facing trans people, particularly intersectional and systemic barriers. This article looks to Canadian trans case law outside of human rights law to reveal the many instances in which trans people’s fight for legal recognition and redress occur outside of the human rights arena. It focuses on trans case law in three areas: family law, the use of name and gender in court, and access to social benefits. Canadian trans jurisprudence illustrates that not only are trans legal strategies outside of human rights plentiful and effective, they are also imperative. An agile and pragmatic approach to trans rights is necessary, particularly when minority rights are under threat, and for trans people on the margins of trans law reforms.

  • Google Scholar (GS) is an important tool that faculty, administrators, and external reviewers use to evaluate the scholarly impact of candidates for jobs, tenure, and promotion. This article highlights both the benefits of GS—including the reliability and consistency of its citation counts and its platform for disseminating scholarship and facilitating networking—and its pitfalls. GS has biases because citation is a social and political process that disadvantages certain groups, including women, younger scholars, scholars in smaller research communities, and scholars opting for risky and innovative work. GS counts also reflect practices of strategic citation that exacerbate existing hierarchies and inequalities. As a result, it is imperative that political scientists incorporate other data sources, especially independent scholarly judgment, when making decisions that are crucial for careers. External reviewers have a unique obligation to offer a reasoned, rigorous, and qualitative assessment of a scholar’s contributions and therefore should not use GS.

  • Summary

    The primary treatment of sarcoma is surgical resection; however, as the understanding of this rare disease has improved, it is now clear that different sarcoma subtypes have varying growth patterns and metastatic potential. Although surgery continues to play the central role in the treatment of sarcomas, pathologic subtyping has allowed characterization of sarcomas that have an improved sensitivity to chemotherapy or radiation therapy. This has translated into a refinement of the surgical approach, and the addition of multidisciplinary treatment in an adjuvant or neo-adjuvant fashion. This review focuses on the surgical management of sarcoma, which is driven by the pathologic subtype.

    CLINICAL EVALUATION AND BIOPSY

    Soft tissue sarcomas (STSs) are often asymptomatic and are usually found incidentally. A survey on the clinical presentation demonstrated that most patients present with a mass, only one third of which cause pain symptoms. There can be an antecedent history of trauma, which is usually not related but often draws attention to a mass. There is often a hesitation to diagnose sarcoma; up to 20% of patients have been found to have a delay of 6 or more months between presentation to a physician and tissue diagnosis.

    The differential diagnosis of a mass includes a hematoma, benign lipoma, lymphoma, germ cell tumor, and sarcoma. A history of an enlarging or changing lesion should raise the suspicion of a malignancy. On physical examination it is important to differentiate between a soft, mobile lesion and one that is fixed or invading local structures.

Vor allem aber ist mir eines dabei deutlich geworden: daß die Geschichte kein einfaches Continuum ist, in dem Sinne, daß das Neue einfach an das unmittelbar Vorhergehende anknüpft, sondern daß sich Gegenwärtiges, Vergangenes, Vorvergangenes und Längstvergangenes zu einem unentwirrbaren Zauberknäuel verflechten, den so und so oft die menschliche Phantasie mit ihren buntesten Fäden umspinnt.
