  • Islamophobia and the Law is a foundational volume of critical scholarship on the emerging form of bigotry widely known as Islamophobia. This book brings together leading legal scholars to explore the emergence and rise of Islamophobia after the 9/11 terror attacks, particularly how the law brings about state-sponsored Islamophobia and acts as a dynamic catalyst of private Islamophobia and vigilante violence against Muslims.     Donald Trump’s December 2015 proposal to “ban Muslims” marked a new highpoint in political animus toward Muslims. It also ushered in a new era of explicit Islamophobia within the political sphere, spearheaded by the man who would come to symbolize it. Far more than a fringe or aberrant policy position, Trump’s Muslim ban helped deliver him the presidency, and developed into a cornerstone of his campaign for the White House.

  • Summary

    Muslims in America are no strangers to prejudice and disparate treatment based on perceived difference. Particularly during moments of crisis, whether local or global, media pundits and academics offer opinions about political Islam and modernity regardless of their actual expertise, while Muslims brace for the inevitable backlash. Much of the current Manichean thinking about Islam has a long history and can be traced back to the very first encounters between Christians and Muslims. But more recently scholars like Bernard Lewis and Samuel Huntington have argued that “Islam” is at odds with “the West” – both of these constructed as mutually exclusive and monolithic. As part of this long-standing tradition of scholarship that seeks to differentiate Islam from Judeo-Christianity and Europe, some experts continue to advance the view that Islam is incompatible with liberal values and democracy at large because of the essential differences between the two.

    Hamtramck is a city that occupies many intersections. Geographically, it is approximately two square miles, swallowed entirely by the city of Detroit. Racially and religiously, Hamtramck is at the latter end of a pivotal crossroads. The city of roughly 22,000 people was once a concentrated and celebrated Polish enclave, a coveted destination for immigrants from the Eastern European nation seeking safe haven and economic opportunity. Today, a declining number of Polish businesses, and a statue of Pope John Paul II on the corner of Joseph Campau and Belmont Streets, commemorating his 1987 visit, symbolize the city's proud Polish and Catholic heritage.2 Taking in the sights and sounds of the city today quickly reveals that Hamtramck, however, is no longer predominantly Polish, but rather a destination and hub for Muslims pursuing the American Dream while heavily steeped in their native traditions.
