In the 1730s English criminal procedure abandoned its centuries-old rule forbidding the defendant in cases of felony to be assisted by counsel. The judges began to allow counsel to examine and cross-examine witnesses on the defendant's behalf, presaging the beginnings of the distinctive Anglo-American adversary system of criminal trial. This article points to two innovations in pretrial practice in the early decades of the eighteenth century that motivated the judges' decision: (1) the increasing influence of solicitors in investigating and preparing witnesses for institutional and private prosecutors; and (2) the growing danger of false witness in prosecutions inspired by a series of reward statutes enacted from 1692 onward. These developments – one-sided lawyerisation and the incentive for false prosecution – unbalanced the old lawyer-free criminal trial and led the judges to allow the assistance of counsel to offset the new advantages of the prosecution.

For cases of serious crime a number of European countries employ a variant of the jury called the mixed court, in which laymen and professional judges sit together in a single panel that deliberates and decides on all issues of verdict and sentence. Trials in the mixed court proceed quite rapidly, in large measure because the mixed court dispenses with most of the time-consuming practices of jury control that characterize Anglo-American trial procedure. Consequently, the legal system can process all cases of serious crime to full trial. The present article describes the German mixed-court system and contrasts it with the American jury, asking to what extent the mixed court serves the purposes of the jury. The conclusion is that the mixed court serves the jury policies well, though not fully; and that it is a superior alternative to the indigenous nontrial devices—plea bargaining and bench trial—that have displaced the jury from routine American practice.

There is growing interest within the investment community in what are known as “index” or “market” funds. These are mutual or other investment funds that have abandoned the traditional attempt to “beat the market” by picking and choosing among securities-buying stocks or bonds that they believe to be undervalued and selling those they believe to be overvalued. Instead, they create and hold essentially unchanged a portfolio of securities that is designed to approximate some index of market performance such as the Standard & Poor's 500. The S&P 500 is a hypothetical portfolio consisting of 500 major nonfinancial companies on the New York Stock Exchange weighted by the market value of each company's total outstanding shares. Batterymarch Financial Management Corporation in its Market Portfolio holds a 250-stock selection from the S&P 500 designed to track the performance of the S&P 500 very closely. Two major banks, American National Bank and Trust Company of Chicago and Wells Fargo Bank, have created market funds in their trust departments. And several large pension funds, including those of several Bell Telephone Companies and of Exxon, have recently placed a portion of their assets in such funds.
