Sehr geehrter Herr Miller,

die Nachricht vom Tode von Prof. Donald Kommers erfüllt uns mit Trauer.

Wir haben nicht nur einen herausragenden Wissenschaftler und Kenner des deutschen Verfassungsrechts verloren, sondern auch einen bedeutenden Freund des Bundesverfassungsgerichts. Tatsächlich ist die Rolle von Donald Kommers als Vermittler von Institution und Rechtsprechung des Bundesverfassungsgerichts in der nicht-deutschsprachigen Welt kaum zu überschätzen.

Die Mitglieder des Gerichts, die Prof. Kommers persönlich kennen gelernt haben, werden ihn in bester Erinnerung behalten. Aber auch für die nachfolgenden jüngeren Richterinnen und Richter wird Donald Kommers vor allem durch sein Standardwerk über das Bundesverfassungsgericht weiterhin von großer Bedeutung sein.

Mit diesem Werk eröffnen uns Prof. Kommers und Sie als Co-Autor die Möglichkeit, das Bundesverfassungsgericht und auch den Rechtsstaat deutscher Prägung all denjenigen nahe zu bringen, die der deutschen Sprache nicht mächtig ist. Wir nutzen dies mit großer Resonanz bei den zahlreichen internationalen Kontakten des Bundesverfassungsgerichts, die uns gerade jetzt, da die Rechtsstaatlichkeit weltweit bedroht ist, besonders wichtig sind.

Wir hoffen, dass die von Prof. Kommers gebauten Brücken auch in der Zukunft tragen und würden uns freuen, hierzu beizutragen. Gerne werden wir Sie nach unseren Möglichkeiten dabei unterstützen, das Werk von Donald Kommers fortzuführen.

The news of Professor Donald Kommers’ passing fills us with sadness.

Not only have we lost an exceptional scholar and a specialist of German constitutional law, but also an important friend of the Federal Constitutional Court. Indeed, Donald Kommers’ role as a promoter of the institution and jurisprudence of the Federal Constitutional Court outside of Germany can hardly be overestimated.

Those members of our Court who had the opportunity to meet Professor Kommers personally will remember him fondly. But also for their more recent successors Donald Kommers will remain a significant figure, in particular through his definitive volume on the Federal Constitutional Court.

By way of this work, Professor Kommers and you as its co-author have opened up the possibility of making the Federal Constitutional Court and the German constitutional state more accessible to anyone who does not speak German. We make use of this to great effect with the Federal Constitutional Court’s numerous international contacts, which are particularly important to us now, at a time when the rule of law is coming under threat worldwide.

We hope that the bridges built by Professor Kommers will continue to endure in the future and we would be glad to play our part therein. We would like to offer you our support to carry forward Donald Kommers’ work.
