  • A full trial has become an uncommon phenomenon in many legal systems, replaced largely by promotion of settlement and plea-bargaining. This book uncovers today's judicial role in this radically changed legal setting using multiple methods. Over five years, researchers analyzed court dockets, studied judges in action, and conducted interviews with judges and lawyers. This book, which spans several legal cultures, follows in the footsteps of the 'vanishing trial phenomenon', probing its existence beyond common law systems. In doing so, it provides insights into the changing judicial role and the metamorphosis of legal systems. Offering a new perspective on possible futures of legal systems, including the use of artificial intelligence, the authors provide a rich context for legal scholars and policymakers to redesign the architecture of conflicts. Moreover, they introduce new jurisprudential perspectives on the relationship between law and conflict resolution, with an emphasis on the judicial role.

  • After centuries of persecution and discrimination, Jews are today often seen as a successful and well-integrated religious minority group in a 'Judeo-Christian West'. This book qualifies this narrative by exploring the legacy of Christian ambivalence towards Jews in contemporary secular law. By placing disputes over Jewish practices, such as infant male circumcision and the construction of eruvin, within a longer historical context, the book traces how Christian ambivalence towards Jews and Christianity's narrative of supersession became secularised into a cultural repertoire that has shaped central ideas and knowledge underpinning secular law. Christian ambivalence, this book argues, continues to circumscribe not only the rights and equality of Jews but of other non-Christians too. In considering the interaction between law and Christian ambivalence towards Jews, the book engages with broader questions about the cultural foundations of Western secular law, the politics of religious freedom, the racialisation of religion, and the ambivalent nature of legal progress.

  • Covering the period from the eighteenth century to the present, A Sociology of Post-Imperial Constitutions combines global history and historical legal sociology to explain how democratic constitutions were created by imperialism and military policies related to imperialism. It challenges common views about the relation between democracy and peace, examining how, in different locations and different periods, the constitutional ordering of citizenship both reflected and perpetuated warfare. It also isolates the features of constitutional systems that have been successful in obviating military violence, separating democracy from its military origins. It discusses how the emergence of democratic government after 1945 depended on a dialectical transformation of the war/law nexus in constitutional rule. It then assesses ways in which, and the reasons why, many contemporary constitutions have begun to remilitarize their societies and to rearticulate military constructs of legitimacy.

  • Kennedy presents a new way of evaluating the regulation of deceptively induced intimacy, that is, sex and sexual/romantic relationships, on the basis of an innovative genealogy of legal responses to this conduct. This book traces the development of a range of civil and criminal laws across c. 250 years, showing how using deception to induce intimacy has been legally understood, compensated and punished. It offers an original interpretation of the form and function of these laws by situating them in their social and cultural contexts. It argues that prevailing notions of what makes intimacy valuable, including the role it plays in self-construction, have shaped and constrained the laws' operation. It shows how deceptively induced sex has come to be treated more seriously while the opposite is true of deceptively induced relationships and concludes by presenting a new framework for deciding whether and when deceptively induced intimacy should be regulated by law today.

  • Modern slavery laws are a response to global capitalism, which undermines the distinction between free and unfree labour and poses intense challenges to state sovereignty. Instead of being a solution, Constructing Modern Slavery argues that modern slavery laws divert attention from the underlying structures and processes that generate exploitation. Focusing on unfree labour associated with international immigration and global supply chains, it provides a novel socio-legal genealogy of the concept 'modern slavery' through a series of linked case studies of influential actors associated with key legal instruments: the United Nations, the United States, the International Labour Organization, the European Union, the United Kingdom, and Walk Free Foundation.   • Jeutner argues that the reasonable person is, at heart, an empathetic perspective-taking device, by tracing the standard of the reasonable person across time, legal fields and countries. Beginning with a review of imaginary legal figures in the legal systems of ancient Egypt, Greece, and Rome, the book explains why the common law's reasonable person emerged amidst the British industrialisation under the influence of Scottish Enlightenment thinking. Following the figure into colonial courts, onto battlefields and into self-driving cars, the book contends that the reasonable person invites judges, jury-members, and lawyers to take another person's perspective when assessing their own or another person's conduct. The perspective of another is taken by means of empathy, by feeling what others might feel in a particular situation. Thus construed, the figure of the reasonable person can help us make more accurate judgments in a diverse world.

  • Ways of Remembering tells a story about the relationship between secular law and religious violence by studying the memorialisation of the 2002 Gujarat pogrom—postcolonial India's most litigated and mediatized event of anti-Muslim mass violence. By reading judgments and films on the pogrom through a novel interpretive framework, the book argues that the shared narrative of law and cinema engenders ways of remembering the pogrom in which the rationality of secular law offers a resolution to the irrationality of religious violence. In the public's collective memory, the force of this rationality simultaneously condemns and normalises violence against Muslims while exonerating secular law from its role in enabling the pogrom, thus keeping the violent (legal) order against India's Muslim citizens intact. The book contends that in foregrounding law's aesthetic dimensions we see the discursive ways in which secular law organizes violence and presents itself as the panacea for that very violence.

  • Legislators in China introduced the charitable trust model in 2016 with the passage of the Chinese Charity Law. They constructed a new legal framework for this model, in order to unlock the potential of trust institutions to further and develop charitable causes. This is the first English-language monograph exploring the governance of Chinese charitable trusts from the perspective of law and sociology. Through the application of doctrinal analysis and semi-structured qualitative interviews, this book reveals that China's particular political, social, and economic conditions are essential to understanding the legislated governance framework for charitable trusts and its implementation in practice. Embedded in China's unique institutional context, the governance of Chinese charitable trusts can only be fully understood in light of relevant law, administrative practice, and private actions taken by charitable trust parties.
