Summary

The chapter outlines the landmark decisions of the US Supreme Court in Glucksberg and Vacco that rejected a constitutional right to physician-assisted suicide. It notes the importance attached by Justice Souter to the Dutch experience and his observation that there was a dispute about whether that experience supported slippery slope concerns. The chapter maintains that the three sources that he thought counterbalanced those concerns – Professor Epstein, Judge Posner, and Professor van der Wal – did not on closer examination do so.
