Summary
The key aspect of the EU investment policy – both internally and externally – has been the relationship between EU law and international law, and the protection of the autonomy of the EU legal order its key objective. Accordingly, law has been the key factor and the Court of Justice of the European Union (CJEU) the key actor in defining the policy scope. With every decision, the Court has allowed the institutions and the Member States to move forward, assisting them in legitimising the policy.
