This concluding chapter considers the reforms of Governor-general Charles, Lord Cornwallis (1786-93) as the culmination of a decades-long process of imperial co-option, whereby British authorities had gradually expropriated and recast a late Mughal, Persianate system of taxation and justice. Cornwallis’s famous minute on civil justice from 1793 proclaimed itself as a great leap forward in its assertion of ‘British’ justice, making all civil disputes over land and taxation cognizable in separate law courts. Yet Cornwallis, like earlier British reformers, while he railed against the supposedly despotic practices of earlier Indian rulers, was also intensely aware of the multitudes of Indian petitioners and agents (wakils) crowding the Company’s ‘adalats and making legal claims on the Company. His minute on civil justice therefore did not simply announce the arrival of a new rule of law, but envisioned it as a crucial engine of colonial pedagogy, which would eventually turn clamorous and unruly Indian litigants into law-abiding subjects.

This chapter shows how the judicial reforms of Governor Warren Hastings in 1772 attempted to recentre sovereign authority in the British settlement of Calcutta by co-opting and recasting late Mughal venues and practices of petitioning and dispute resolution. It explores how Hastings attempted to found the Company's legal system, not just on 'religious' forms of Muslim and Hindu law, but on Mughal practices of revenue administration. Even after 1772, the chief revenue office in Calcutta (khalisa sharifa or ‘khalsa’) – retained an important role as a site for investigating disputes over land and revenues, and for discovering a new form of ‘civil law’ based on the Company’s interpretations of late Mughal precedents.

In early colonial Bengal, pervasive disputes between urban creditors and tax-paying landlords (zamindars) shaped the East India Company's emergent system of civil justice. Mediating conflicts between creditors and landed debtors was already an important aspect of rulership under the nawabs of Bengal. The Company’s efforts at fiscal centralization, raising tax demands on landholders, and auctioning off ‘revenue farms’ – rights to collect local revenues in return for payments agreed in advance – to wealthy merchants (banians), further intensified conflicts in the countryside. By exploring the controversial efforts of banians to accumulate land rights, and by tracing the Company's hesitant efforts to adjudicate disputes over land and credit, this chapter further reveals how the Company's strategies of legal and fiscal centralization depended on the adaptation and reworking late Mughal, Persianate practices of claimsmaking and dispute resolution. It shows how the Company's efforts to consolidate zamindari rights as a saleable, mortgageable form of taxable private property were being worked out as much in judicial inquiries and decrees as in central legislation.

This chapter explores how inheritance disputes involving landholders (zamindars) in early colonial Bengal became a site for the production of a Persianate form of Hindu law. By tracing in detail the process of judicial investigation in two complex cases of of zamindari inheritance involving elite Hindu zamindars, the chapter shows how British officials drew on the expert knowledge of khalsa revenue officials (especially qanungos) and of brahman pandits (experts on dharmashastra), and how the Company government tried to justify its judicial decrees on the basis of a reconstituted form of Mughal law. The records of judicial inquiries into zamindari tenures reveal the Persianate context for the Company’s early administration of Hindu law, as nawabi practices for hearing and deciding disputes among tax-paying zamindars were reformulated under the Company state.

This chapter explores the late Mughal context for colonial-state-formation, focusing on Persianate practices of claimsmaking and dispute resolution in nawabi Bengal. It examines Persian accounts of Mughal and nawabi governance circulating in the orbit of the East India Company government in late eighteenth century Bengal, as well as British views of Mughal institutions, highlighting the role of late Mughal tax officials administering justice to petitioning subjects in disputes about land and taxation. It shows how the central revenue office of the Bengal nawabs, the khalisa sharifa, became a key site for the Company's colonization and transformation of Mughal, Persianate practices of legal ordering.

Chapter four returns to developments in north India, now from the mid-fourteenth through mid-sixteenth centuries. By the end of the fourteenth century, territories once under the Delhi Sultanate’s umbrella emerged as independent states. Political, economic, and cultural developments in Bengal, Gujarat, Jaunpur and Malwa are the initial focus, then we turn to Rajasthan, especially Mewar under the powerful Sisodiya ruler Rana Kuumbha. The remainder of this chapter focuses on important cultural trends across the north, including mosque and temple construction, literary developments as the use of vernaculars expanded, and widening religious beliefs. These include the spread of Sufism, the significant rise in Sant traditions including Kabir, and the increasing popularity of Krishna veneration.

It is generally acknowledged that Hinduism, as the name of a distinct religion, did not exist before the nineteenth century. Before that, “Hindu” had simply meant “Indian” and encompassed a variety of beliefs and practices (diffuse spirituality). There were also indigenous “Thomas Christians” dating from the 1st century CE. When missionaries arrived, lower caste groups found Christianity attractive. A sea-change occurred around the nineteenth century when Westerners found “Hinduism” to be incurably superstitious. Indians responded by reforming their practices (towards concentrated spirituality). Christianity continued to appeal to marginalized groups such as women, untouchables, and aboriginal ethnic groups. Hindu nationalists continue to view Christianity with suspicion.

After an in-depth analysis of the making of Dutch territorial power in the Indonesian archipelago, Ceylon and Malabar, the two final chapters take an even more Asian perspective on the more marginal Dutch presence in South and West Asia. Through a Dutch window, this chapter perceives a so far undetected Indian world-economy that focuses on the bustling Mughal port city of Surat. Other regional chapters likewise stress the crucial role of Indian commercial brokers, not only in the Indian subcontinent but extending towards the Red Sea and the Persian Gulf. The Dutch can only accede to these already highly sophisticated and integrated trading systems of the Indian Ocean. Their operations are crucially facilitated by their increasingly monopolised access to both Indonesian spices and Japanese bullion. Despite its marginal position in the Mughal and Safavid Empires, it was not the spices of the archipelago and Ceylon, but the products of India (opium, saltpetre and in particular textiles) which started to dominate the global markets of the eighteenth century. These commodities gave the edge to the previously overpowered but now re-emerging British, be it as Company or, increasingly so, as private traders.

In Calcutta in the 1860s, there was litigation in the newly established High Court over the rights of Indians who worked the land. Using English legal concepts, the chief justice saw the agriculturists as being little more than tenants-at-will. He arranged to sit with judges who supported his views until he went on a temporary visit to England. In his absence, two judges decided a case in which attention was given to the customs of Bengal and more extensive rights were accorded to numerous rural workers. After the return of the chief justice, the conflicting case law precipitated what contemporaries came to call The Great Rent Case. A Full Bench of the High Court now found, by a large majority, for those who worked the land. It was as if the new High Court had discovered sufficient self-confidence to assert itself within the colonial life of Bengal. The present study explains the process of judicial decision-making by reference to the influence of three colonial networks in Calcutta.

Once covered by the enormous and highly biodiverse Bengalian rainforest, the region was attractive to early humans, who gradually developed settled rice cultivation. Archaeological finds show complex and multilingual prehistoric societies that established urban cultures. Today the ruined remains of fortified cities and large religious structures testify to Bangladesh’s early human history.

The Anglo-Mughal War of 1686–1690 is the focus of Chapter 5, which seeks to challenge traditional understandings of the war as the result of a more capable and belligerent Company seeking to impose its will on the Mughal empire and expand its territory and rights by force, culminating in the acquisition of Calcutta. Instead, this chapter places the war within the context of the personal tensions and conflicts produced by the transcultural ties which bound Company servants and Mughal elites together. Some servants sought to renegotiate these increasingly one-sided relationships with a limited show of force, for which they were immediately expelled from Bengal by the Mughal government. Only after ten years of complex negotiations, in which new transcultural relationships were established with an entirely new Mughal regime, could the Company return and develop Calcutta as a settlement. Even then, its expansion relied on the Company’s utility to the new Mughal regime, to which they contributed men and money to uphold the nawab’s authority against several large-scale rebellions. By the turn of the eighteenth century, the Company transformed itself into a key client of the Mughal government which could be mobilised to consolidate the empire’s control of Bengal in exchange for greater rights and privileges.

This chapter shifts the focus onto Bengal, and the various strategies adopted by the Mughal empire in accommodating and subordinating the Company’s growing presence in the province of Bengal. If the integration of Company servants into surrounding communities at Madras and their subordination to the sultanate of Golconda unlocked a range of rights and privileges which allowed them to expand their presence on the Coromandel Coast, the opposite was true in Bengal. The English experience in Bengal represented the Company at its most subordinate, pliant and, indeed, weakest, utterly subservient to the communities, elites and rulers whom they relied on. This situation was compounded by the growth of interloping communities, who were even more effective than Company servants in integrating themselves socially, culturally and commercially with Indian communities and elites, assuming many of the subordinate services that Company servants had traditionally fulfilled. Skilful Mughal governors played these groups off against one another, utilising interloping and Company networks for their own benefit, without needing to concede any substantial rights or autonomy to either. In maintaining a plural commercial environment, Mughal elites ensured their place at the top of local hierarchies of wealth and power.

Between the mid-seventeenth and late eighteenth centuries, the ambition to domesticate sericulture was carried to all corners of northern Europe and the Atlantic world in a range of different polities: Sweden, New England, Russia, Ireland, Prussia, the Carolinas, Poland. The attempts to bring forth a new domestic sericulture in these regions were driven by the same core cultural and economic impulses that had long helped silk to spread, often stimulated by investment from state authorities interested in import substitution. The heightened sense of investment opportunity that characterised these efforts, however, was new. It was magnified in the century after 1650 by the dramatic acceleration in the global consumption of silk goods, and by the opening of new agricultural lands across the Atlantic and new textile markets in Africa and the East Indies. This chapter explains that few European states persisted with the project across time and space as extensively as did the British, whose case for introducing sericulture was relentlessly reinforced over the long eighteenth century because of Britain’s distinctive territorial reach into the Atlantic and Indian Ocean worlds, and its simultaneous development of an expansive hybrid silk industry at home that serviced global markets.
