A key element of the right to self-determination is territorial integrity. This has usually been considered solely in relation to the territorial integrity of an existing State seeking to resist claims by peoples for the right to self-determination. Yet the Chagos Opinion by the International Court of Justice examines a different type of territorial integrity—that of the colonial territory itself. This article explores the consequence of the Court's view that the territorial integrity of the colonial territory is a matter of customary international law, and that any division, integration or other disruption of that colonial territory after December 1960 is unlawful, without the free and genuine consent of the people of the colonial territory. In particular this article seeks to explore what the Chagos Opinion means in terms of the territorial integrity of a colonial territory. It also examines the required conditions for ascertaining a free and genuine consent of the people of that territory, and the legal effects of not complying with them. There is also consideration of the implications for other situations from the clarification of customary international law in the Chagos Opinion, with a special focus on West Papua.

Public international law norms are relevant to a wide range of the sustainable development goals. Yet there is a frequent failure to connect the two spheres and there is very limited literature on the interaction between public international law, and the policy and political frameworks that underpin development.

This article considers the practices of companies worldwide in attempting to implement human rights due diligence (HRDD) as envisaged by the Guiding Principles on Business and Human Rights. Based on empirical research conducted through surveys and interviews, it analyses corporate practices in this area. It examines the responses of companies with reference to the core elements of implementing HRDD: identifying actual or potential human rights impacts; taking action to address these impacts; and tracking or monitoring the effectiveness of actions. In addition, the article places these practices in the context of the legal developments in the field of HRDD. The research shows the difference that dedicated HRDD – in comparison with non-human rights specific processes – can make in terms of identifying adverse human rights impacts of both the company as well as of those which are part of its business relationships.

This article aims to offer a definition of the international rule of law. It does this through clarifying the core objectives of a rule of law and examining whether the international system could include them. It demonstrates that there can be a definition of the international rule of law that can be applied to the international system. This definition of the international rule of law is not dependent on a simplistic application of a national rule of law, as it takes into account the significant differences between national and international legal systems. It seeks to show that the international rule of law is relative, rather than absolute, in its application, is not tied to the operation of the substance of international law itself, and it can apply to states, international organizations and non-state actors. It goes further to show that the international rule of law does exist and can be applied internationally, even if it is not yet fully actualized.

Access to an effective remedy is part of the third pillar of the United Nations Guiding Principles on Business and Human Rights (Guiding Principles). It should require states to provide access to judicial remedies for human rights violations, even those that have occurred outside the territory of the state by a corporation domiciled in that state, especially where claimants “cannot access [their] home State courts regardless of the merits of the claim.” While the decision of the U.S. Supreme Court in Kiobel v. Royal Dutch Petroleum Co. may seem to overwhelm or even drown some of the expectations of such remedies within the United States, the case law in the rest of the world is unlikely to be greatly affected by the ruling due to the jurisdictional and legal system foundations of other states. This article will examine the main case law and judicial remedies sought across the world, with a special emphasis on Europe, where the majority of large non-U.S. transnational corporations have their headquarters.

Seventy-nine species of weevils are newly reported in Nova Scotia and 66 species are newly reported on Prince Edward Island, increasing the known provincial weevil faunas to 244 and 92 species, respectively. Thirty-six species are recorded for the first time in the Maritime Provinces; of these, Ceutorhynchus pallidactylus (Marsham), Listronotus dietzi O'Brien, Corthylus columbianus Hopkins, and Orchidophilus aterrimus (Waterhouse) are recorded for the first time in Canada. Orchidophilus aterrimus has been collected only in exotic domesticated orchids and is not established in the wild. Fourteen species previously recorded on Cape Breton Island, Nova Scotia, are reported from the provincial mainland. Four species — Curculio sulcatulus (Casey), Ceutorhynchus squamatus LeConte, Tachyerges niger (Horn), and Ips calligraphus (Germar) — are removed from the faunal list of Nova Scotia, and three species — Temnocerus cyanellus (LeConte), Curculio nasicus (Say), and Cryphalus ruficollis ruficollis Hopkins — are removed from the faunal list of Prince Edward Island. The combined known weevil fauna of the Maritime Provinces now totals 290 species. The adequacy of collection effort is discussed and in Nova Scotia, where collection effort has been greatest, distribution patterns of selected groups of species are examined. Island faunas are discussed with respect to those of Prince Edward Island and Cape Breton Island. Regional biogeographic patterns of species are also discussed, including possible disjunct populations in Nova Scotia and species that may not have crossed the isthmus of Chignecto to colonize Nova Scotia. Attention is drawn to the long history of introduced species in the region and to ongoing introductions through an examination of the earliest records for the 60 introduced species found in the region.

The dominant international legal theories are based on an understanding of international law in terms of a solely state-based system. This article challenges those theories in the context of the practice of the participants in the international legal system. It proposes an inclusive conceptual approach which acknowledges that non-state actors have distinct and independent international rights, responsibilities, and abilities to bring claims, as well as clear roles in the creation, development, and enforcement of international law, which are separate to that of states. While states currently have a primary role in the international legal system, this role is not exclusive.
