Le droit de la guerre aérienne reste encore l'un des domaines les plus controversés du droit de la guerre, et ce, en raison des expériences accumulées depuis 1939 et d'une codification seulement partielle. Le Protocole additionnel I aux Conventions de Genève, qui contient les dispositions relatives au droit de la guerre aérienne, ne s'étant jusqu'à présent pas encore vu reconnaître l'importance qu'il mérite en raison des hésitations dont sa ratification fait l'objet, il convient d'accorder d'autant plus de poids à l'évolution historique de ce droit.
