Obscénité, sexualité et droit: étude sur l'effectivité du discours juridique au Canada, 1892–1970

Abstract

This article explores the question of the effectiveness of legal discourse. In view of the limitations of hermeneutic and socio-political approaches to the study of law, it must be asked how the law succeeds in maintaining its claim to say what is just and to persuade people of the necessity for repression when that which it exercises is, in sum, pretty slight. Based on a study of judgments in obscenity cases published in Canada between 1892 and 1970, this article shows that the judiciary sought to frame and change a social practice pertaining to the question of socio-sexual relations to the point of obliterating it, thereby depriving civil society of the capacity to discuss the ethical questions in issue.

Résumé

Cet article pose la question de l'effectivité du discours juridique. Constatant les limites des approches herméneutiques et socio-politiques à l'analyse du droit, il s'agit alors de se demander de quelle manière le droit réussit à maintenir sa prétention à dire le juste et à persuader de la nécessité de la répression alors qu'il n'en exerce somme toute que très peu. À partir de l'examen des arrêts publiés au Canada entre 1892 et 1970 en matière d'obscénité, l'article montre que le judiciaire s'emploie à encadrer et transformer une pratique sociale portant sur la question des rapports socio-sexuels jusqu' à l'oblitérer, dépossédant ainsi la société civile de toute capacité d' en discuter les enjeux éthiques.
