“After Germany’s withdrawal from the League of Nations, this is obviously intended to apply to the case that the invitation to Germany to be decided upon by the League Council … has not even been given.”

11 Art. 17, par. 2, requiring the Council to institute an inquiry and to “recommend such action as may seem best and most effectual in the circumstances” is applicable “upon such invitation being given.” Note that this paragraph does not involve the application of Art. 16. Moreover, the Franco–Soviet Treaty imposes no obligations with respect to this paragraph.
