Summary

Among the most controversial and difficult issues faced by human rights today are those concerned with sex, gender, and the degree to which human rights norms should govern relations between men and women in the private, as well as public, realm. Nondiscrimination against women has long been a fundamental right, although broader mandates to abolish stereotypes of men and women have proved to be more problematic. The rights of LGBT persons have generally been included within the prohibition against discrimination based on sex and the right to privacy, although expanding these protections to include various forms of gender expression and identity has not yet achieved consensus. It is important to distinguish between the universal norms applicable to government actions and the broader social goals of increasing acceptance and tolerance by individuals and society at large. Advocates also should take care to distinguish between what human rights are and what they should be.
